286 the deponant that a Certain poplar was his bounder and that afterwards the said deponant came with Thomas Ralph to the same tree and it was marked with sixteen Notches and that the notches seemed to have been made a great while and that the said deponant came to the same tree by himself and it was marked with siteen sixteen notches which tree was then a growing tree and that the tree we are now at being fell down is the very tree being on the north side of the main Road that goes up Quantico to the mill and near the head of a Creek Called Whittys branch and on the westermost side of said Creek and further saith not his James J R Russell (seal) mark The deposition of Thomas Ralph aged about fifty seven years having first taken his oath on the holy evangelist of almighty ^God^ saith that about thirty three years ago Edward Bennet now dec.d told him that there stood a marked poplar on a peice of Level ground on the lower side of a Creek Whittys branch near the old Wading place was the first bounder of spans Neck and that about ten or twelve years after James Russell the above deponant told the now d^e^ponent that the said poplar was the bounder of Nehemiah Nicholson and that the said poplar was then marked with sixteen notches and that said notches seemed to have been made a Considerable time and further saith not his Thomas I Ralph (seal) mark By Vertue of the within Commission directed to us the subscribers we have appointed According to said Commission Examined the above Evidences on their Corporall oaths what they had to declare Concerning the first bounder of westloe neck Given under our hands and seals this thirteenth day of September Annoquie Domine 1736 Jas Makmorie (seal) Day Scott (seal) Alexr Leckie (seal)
to be our Comissioners to Examine Evidences on behalf of a Certain Alexd Adams Clk of the County afd in relation to the bounds of part of a tract of land Called Tonys Vinyeard We therefore Require you or any three or two of you at some time and place as to you or any three or two of you shall seem Convenient you meet on the afd Land Called Tonys vineyard (you first having taken your oaths on the holy evangelist of almighty God according to act of assembly in such Case made and provided and there caus to come before you or any three or two of you all such such Evidences as shall be to you or any three or two of you nominated by the said Complainent or deft if |
