282 hundred and thirty six Came againe as well the afd Thomas Fletcher as the afd Abraham Mannering by their attorneys afd and whereupon the same Abraham Mannering prays further Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the afd Thomas here also &c Att which said next Court to witt the seventeenth day of August anno Dom one thousand seven hundred and thirty six Came againe as well the afd Thomas Fletcher as the afd Abraham Mannering by their attorneys afd And whereupon the same Abraham Mannering prays further leave thereof to Imparle her untill next Court and he hath it and the same day is given to the afd Thomas her also &c Att which said next Court to witt the sixteenth day of November Anno Dom one thousand seven hundred and thirty six Came againe as well the afd Thomas Fletcher as the afd Abraham Mannering by their attorneys afd And whereupon the same Abraham as before defends the force and Injury when &c and says he is not Guilty of the premises above upon him imposed in manner and form as the said Thomas above against him hath Complained and of this he puts himselfe in the Country and the afd Thomas in like Manner Thereupon it is Commanded the sheriff of Somerset County that Immediately he should Cause to Come here before the Justices of his Lordship County Court of Somerset now sitting at dividing Creek in the same County twelve &c by whom &c and who neither &c to Recognize &c because as well &c and afterwards Immediately Came thereof the Jury &c and the Jurors of that same Jury by Joseph MccClester Gent sheriff of the County afd to this Impannelled being Called came to witt David Polk Robert Mitchell Benjamin Tull Thomas Winder John Perkins James Houston John Roach William Kitchen William Porter Huet Nutter William Gray Robert Hall who to Say the truth of the premisses afd being duely Elected tryed and Sworn upon their Oath Sayd that the afd Abraham Mannering is guilty of the premises afd above upon him Imposed in manner and form as the said Thomas above against him hath Complained and assessed the damages of the Same Thomas by Occasion of the premisses afd beyond his costs and Charges by im about his Suit in that part apposed to ten Shillings Curr.t money of Maryland and for those Costs and Charges to One pound of tobacco Therefore it is Considered that the afd Thomas Fletcher recover against the afd Abraham Mannering his damages afd by the Jurors afd in form afd assessed also One hundred and Twenty One pounds of tobacco for his Costs and Charges afd to the Same Thomas by the Court hereof his assent of Increase adjudged which Certain damages in the whole do amount to ten shillings Curr.t money of Maryland and One hundred and Twenty two pounds of tobacco and the afd Abraham in Mercy &c |
