277 Chattells which were the said Benjamins at the time of his death to the value of the residue of the said debt whereby he was able to make satisfaccon to the said Whittington that is to say at Somerset County afd and this he prays may be enquired of by the Count^r^y and the said Capell likewise prays the same &c Afterwards to witt the Sixteenth day of November Anno Dom One thousand Seven hundred and thirty Six afd Came hereinto Court the afd Whittington King by his attorney afd afd and Confesseth himselfe here in Court that he will noe further prosecute against the afd Capell King Executor as afd in the plea afd Therefore it is Considered that he and his pledges of prosecuting to witt John Doe and richard Roe be in mercy and that the afd Capell King Executor of the same Benjamin Goe thereof without day &c also it is Considered that the afd Capell King Recover against the afd Whittington King his damages afd by occasion of the premisses 327 afd to Three hundred and Twenty Seven pounds of tobacco to the same Capell at his request for his Costs and Charges in that part Sustained according to the form of the statute thereof Lately made and provided by the Court here adjudged and the afd Capell have thereof execution &c
Complains that whereas a certain Thomas Belling the ninth day of December in the year of our Lord one thousand seven hundred and thirty four at Somerset County within the Jurisdicon of this Court the same Thomas then and there negotiateing and Comerce useing his certain bill in writing according to the use and Custom of Merchants from the time whereof the Memory of man is not to the Contrary used and approved did make and with is proper hand subscribed bearing date the same day and year and that bill unto a Certain Charles Ramsey by the name of M.r Charles Ramsey then and there negotiateing and Comerce useing did direct and by the same bill did desire the said Charles to pay or cause to be paid upon demand unto the afd Robert Mackfarling then and there Negotiateing and Comerce useing nineteen thousand shingle good and well drawed and Joynted at Convenient Landing on the River which said bill so as afd made subscribed and directed the same Robert Mackfarling after the making thereof (to witt) the fifteenth day of December in the Year afd at Somerset County aforesaid unto the said Charles then and there delivered and the |
