275 whereas aforesaid Henry the ninteenth day of January in the Year of Our Lord God seventeen hundred thirty and five at Somerset County afd by his certian bill obligatory which the same Thomas with the seal of the afd Henry sealed hereinto Court doth bring the date whereof is the same day and year had Acknowledged himself to owe unto the afd Thomas the afd sum of twelve hundred and eight pounds of good tobacco to be paid unto the afd Thomas therefore afterwards he should be required to which payment well and truely to be made the afd Henry did bind himself firmly by the same bill Nevertheless the afd Henry altho often required the afd sum of tobacco unto the same Thomas yet hath not paid but that unto him hitherto to pay altogether hath refused and still doth refuse to the damage of the same Thomas two thousand four hundred pounds of tobacco and thereupon he bringeth suit &c Pledges &c Jno Doe R Roe And the afd Henry Wingate by William Beckingham his attorney Cometh & Defendeth the force and Injury when &c and Saith that he Cannot gainsay the action afd of the afd Thomas nor Can he say but that the writing Obligatory afd is the deed of the Same Henry nor but that he Owes the same Thomas the afd One Twelve hundred and Eight pounds of tobacco in manner and form as the fd Thomas first above against him hath declared Wherefore the same Thomas Prays Judgm.t for his debt afd and his damages sustained by Occasion of the detaining of the same debt to him to be adjudged &c Therefore it Considered by the Court here that the said Thomas Watkins recover against the afd Henry Wingate his debt afd and his damages Sustained by occasion of the 187 detaining of the said debt to One hundred & Eighty Seven pounds of tobo to the same Thomas of his assent by the Court here adjudged and the afd deft in Mercy &c
And whereupon the same John by William Beckingham his attorney saith that whereas the afd William Kitchen the twentieth day of October Anno Dom seventeen hundred thirty six at Somerset County afd by his certain writing Obligatory had granted himself to be bound unto the afd John in the afd sum of forty three pounds tenn shillings and eight pence sterling to be paid unto the same John when thereunto afterwards he should be required Nevertheless the afd William Kitchen altho required the afd forty three pounds tenn shillings and eight pence unto the afd John hath not paid but that unto him hitherto to pay altogether hath refused and still doth refuse to the damage of the same John fifty pounds sterling and two thousand pounds of |
