199 above account is Just and true as it stands their stated and that he nor any other person for his use directly or Indirectly did never receive any part or pcell thereof nor any thing in Satisfaction or security for the same to his knowledge sworn to the day above before RKing 1731 Somerset County Whereas it has been made appear by Joseph Tillman and others that Stephen Odear late of Coventry parish planter is obsconded and fled from Justice to the less and Damage of his Creditors These are therefore to require you on sight hereof psuant to an act of assembly in such cases provided to Issue attachment for the sum of seven pounds eleven shillings and eight pence Currant money debt due to the said Joseph Tillman and Damages in the Usuall form and for your soe doeing this shall be your warrant dated at Monoken the 19.th day of aprill 1735 To Thomas Hayward Cl Somerset County sher RKing Pursuant to an act of assembly of this province now in force and in Obediance to the abovsaid Warr.t was Issued an attachmt against the goods Chattells rights and Creditts of the afd Stephen Odear the tenor whereof followeth in these words vizt Somerset sst Charles absolute Lord and proprietary of the provinces of Maryland and avalon Lord Baron of Baltemore &.c To the sher of Somerset County Greeting wee Command you that you attach any of the goods Chattles rights or Creditts of Stephen Odear late of Somerset County planter if they shall be found in your bailywick to the value of seven pounds eleven shillings Currant money and five hundred pounds of tobacco and when you have the same attached or any part thereof the same in your Custody safe keep so that you have the same before our Justices of our County Court of Somerset to be held at dividing Creek the third tuesday of June next then and there to be Condemned according to act of assembly to and for the use of a certain Joseph Tillman unless the said Stephen Odear by himself or his attorney shall appear and answer unto the said Joseph Tillman of a plea of trespass upon the case &a According to Law and that by good and Lawfull men of your bailywick you make known unto the person or persons in whose hands you make the same attachment so that he she or they be and appear before our Justices of our County Court to be held as af.d to shew caus if any he she or they have why the same goods Chattels rights or Credets so attached in his or their hands ought not to be Condemned and Execution thereof had and made according to act of assembly in such case made and provided if to him her or them it shall seem meet and how you shall Execute this writt that you make known unto our said Justices at the day and place af.d and have you then and there this Writt Wittness John Smith Gen.t one of our Justices of our said Court the twentith day of March Anno Dom one thousand seven hundred and thirty five Att which said third Tuesday of June to witt the fifteenth day of the Same month anno Dom one |
