1735 125 and thereupon the said John Lamberson as before defends the force and Injury when &.a & says that he did not assume upon himself in manner & form as the said John White above against him hath complained and of this he putts himself upon the Country &.a And the plf.t likewise &.a Thereupon it is Commanded the Sheriffe of Somerset County that Immediately he Should Cause to Come here before the Justices of his Lordships County Court of Somerset now here sitting at dividing Creek in the Same County twelve &.a by whom &.a and who neither &.a to Recognize &a because as well &.a and afterwards Immediately Came thereof the Jury &.a and the Jurors of that Same Jury by Joseph MaClester Gent Sheriff of the County afd to this Impannelled being Called came to witt Mathew Hopkins Thomas Dixon John Williams William Fasit Phillip Quinton Peter Claywell Thomas Pullett Hutton Hill Joshua Porter John Paty John Webb John Perkins who to Say the truth of the premisses ^aforesaid^ being duely Elected tryed and Sworn upon their Oath Sayd that the aforesaid John Lamberson did assume upon himselfe in manner and form as the aforesaid John White above against him hath Complained and assessed the damages of the Same John White by Occasion of the nonperformance of the promise and assumption afd beyound his Costs and Charges by him about his Suit in that part apposed to five pounds Curr.t money of maryland and for those Costs and Charges to one pound of tobacco Whereupon the Same John Lamberson by his attorney afd prays the Justices of his Lordships County Court of Somerset that they would dissolve themselves into a Court of Chancery and give Judgmt between the parties afd according to Equity and good conscience as by act of assembly in Such Case made and provided; which is to him Granted he fileing his bill in Equity for that purpose that his Said Lordships Justices may proceed thereon &a
Creek the third Tuesday of March then next to answer unto John Follows of a plea of Trespass upon the Case &.a and that thereof he Should not fail &.a Att which said Third tuesday of March to witt the Eighteenth day of the same month anno Dom One thousand seven hundred and thirty Four being the day of the return of the said Writt Cometh the said Jno Follows by |
