County aforesaid within the Jurisdiction of this Court did make his Certain note in Writing Called a promissory note with his proper hand writing Subscribed bearing date the day and Year aforesaid and the note aforesaid to the Said Samuel then and there delivered by which note the aforesaid Thomas did oblige himself to pay to the said Samuel one thousand pounds of good sound fatted beef and the hides by the tenth day of November then Next Ensuing the date of the Note aforesaid and by Virtue whereof and also by force of the Statute in that case made and provided the aforesaid Thomas became Chargeable to pay to the same Samuel the quantity of beef and hides aforesaid according to the tenor of the said note and being so thereof chargeable the aforesaid Thomas afterwards Viz on the day and Year aforesaid upon himself did assume and to the same Samuel then and there faithfully promise to pay the aforesaid quantity of beef and hides according to the tenor of the Note aforesaid Nevertheless the aforesaid Thomas his promise and assumption aforesaid in Manner and form aforesaid made little Regarding but Minding and fraudulently intending the aforesaid Samuel in that part Craftily and Subtilly to deceive and Defraud the aforesaid One thousand pounds of Good sound fatted beef and the hides by the tenth day of November next Ensuing the date of the note aforesaid to the aforesaid Samuel hath not paid but the same to him hitherto to pay hath altogether refused and still doth refuse to the damage of the same Samuel fifteen pounds Current money of Maryland and thereof he brings suit &a pledges &a John Doe R Roe And the afd Thomas Billings by Francis Allen his attorney Cometh and Saving to himselfe all manner of advantages as well to the writt as to the declaration afd and prays Leave thereof to Imparle here untill next Court and he hath it and the Same day is given to the afd Samuel Oldham here also Att which said next Court to witt the twenty first day of November anno Dom one thousand Seven hundred and thirty two Came again as well the afd Samuel Oldham as the afd Thomas Billing by their attorneys afd and whereupon the same Thomas prays further leave thereof to Imparle here untill next Court and he hath ^it^ and the Same day is given to the afd Samuel here also &a Att which said next Court to witt the Twentieth Day of March ann.o Dom one thousand seven hundred and thirty two Came again as well the afd Samuel Oldham as the afd Thomas Billing by their attorneys afd and whereupon the same Thomas prays further leave thereof to Imparle here untill next COurt and he hath it and the same day is Given to the afd Samuel here also &a Att which said next Court to Witt the Nineteenth Day of June Anno Dom One thousand seven hundred and thirty three Came again as well the afd Samuel Oldham as the afd Thomas Billing by their attorneys afd and whereupon the same Thomas prays further leave thereof to Imparle here untill next Court and he hath it and the same day is given to the afd Samuel here also &a Att which said next Court to Witt the twenty first day of August Anno Dom one thousand seven hundred and thirty three Came again as well the afd Samuel Oldham as the afd Thomas Billing by their attorneys afd And whereupon the same Thomas Billing prays further |
