1734 231 the af.d twenty pounds in manner af.d unto the af.d Thomas Lambden hath not paid but that unto him hitherto to pay altogether hath refused and Still doth refuse to the damage of the same Thomas Lambden forty pounds and thereupon he bringeth Suit &.a and doth bring hereinto Court the writing obligatory af.d which the debt af.d in form af.d doth testify the date whereof is the same day and year af.d &a pledges &.a John Doe & Rich.d Roe And the aforesaid Thomas Billings by William Beckingham his attorney Cometh and defendeth the force and Injury when &.a and Saith that he cannot gainsay the action af.d of the af.d Thomas Lambden nor can he say but that the writing obligatory af.d is the deed of the same Thomas Billing nor but that he owes the Same Thomas Lambden the aforesaid Twenty pounds ^to be paid in Cash wheat or tobo^ in manner and form as the aforesaid Thomas Lambden above against him hath declared &.a Therefore it is Considered that the aforesaid Thomas Lambden recover against the aforesaid Thomas Billing his debt aforesaid and his damages by Occasion of the detaining of the 280 same debt to Two hundred & Eighty pounds of Tobacco to the same Thomas Lambden of his assent by the Court here adjudged and the af.d Thomas Billings in Mercy &.a
Curr.t paper Money of the province of maryland which to him he oweth and Unjustly detaineth &.a And Whereupon the same Peter by George Douglas his attorney saith that whereas the said George Bowen on the Eighteenth day of November in the Year of our Lord seventeen hundred and thirty four at Somerset County by his certain writing obligatory acknowledged himself to be held and firmly bound unto the af.d Peter in the af.d sum of forty one pounds fourteen Shillings and Eight pence to be paid to the said Peter his Ex.rs Adm.rs or assigns Nevertheless the af.d George Bowen altho' often required the af.d forty one pounds fourteen shillings and Eight pence or any penny thereof to the ^same^ Peter hath not paid but that unto him to pay or for the same in any sort to Content hitherto altogether hath refused and still doth refuse to the damage of the same Peter fifty pounds Like money and thereof he brings suit &.a and brings into Court the writing af.d which the debt af.d in form af.d testifies &.a pledges &.a Jn.o Doe & R.d Roe And the aforesaid George Bowen by William Beckingham his attorney Cometh & defendeth the force and Injury when &.a and Saith that he cannot gainsay the action af.d of the af.d Peter Stewart nor can he say but that the writing obligatory af.d is the deed of the same George Bowen nor but that he owes the same Peter Stewart the (aforesaid |
