214 Complainent or Defd.t if any Touching the truth or remembrance of their knowledge or any thing that may relate to the Cause af.d and that Reduceing the Severall depositions into writing you send the same together with this Comission under your or any three or two of your hands and Seals to us to our County Court of Somerset with all Convenient Speed Wittness Robert King Gent Chief Justice of our said Court the twenty third day of august in the Twentieth year of our dominion &.a Ann Dom One thousand Seven hundred and thirty four On the back side of the foregoing Comission it was Endorsed as Followeth Vizt Be it remembered that this day to wit the 17 day of October 1734 Came Peter Shirman and John Disharoon before me the Subscriber and was duely quallified to Execute the within Commission according to act of assembly Sworn before me Tho: Gilliss Likewise to the same Commission were annexed the Following depositions Viz.t The Deposition of John Christopher aged Sixty four years or there about being sworn sayeth that about forty years by past he was going a long the road by a plantation where Jarvis Ginkins now a little to the north ward of the said Ginkinses orchard on the north side of a small drean where now stands a marked pine notcht with Six notches on two sides and two notches on the other two sides he saw some Endians falling of a pine tree which was a bounder of a tract of Land belonging to Nicholas Toadvine and this deponant went to them and told them that it was a bounder of Nicholas Toadvines and that they should not have cutt it but it was too for gone so they fell the tree and further sayeth not Sworn before us Peter Shirman (seal) John Disheroon (seal) The deposition of Jarvis Ginkins aged forty years or there about being sworn sayeth that about Twenty Six years by past Nicholas Toadvine Sen.r told him that there was a bounder of his a little to the northward of this deponants orchard but that it was down and this deponant went that way and found a pine Lying down with notches to be seen ^in^ it tho' the tree was Rotten a little to the northward of a Small drean where now stands a marked pine notcht with Six Notches on two sides and two notches on the other two sides this deponant further sayeth that Nicholas Toadvine Jun told him that it was his fathers bounder and this deponant saw Nicholas Toadvine set up a White Oak stake in the hole where the tree grew and further sayeth not Sworn before us Peter Shirman (seal) John Disheroon (seal)
