(204) within the Jurisdiction of this Court did Import two Negroes into the district af.d in Somerset County af.d within the Jurisdiction af.d and in the province af.d and that the same Isaiah Bredall for the same two Negroes or Either of them with the said Arnold Elzey whilst he the said Arnold Elzey was and Continued Naval officer of the district af.d or with the said Levin Gale since he was Appointed Naval officer of the district af.d did not account or two pounds sterling or any part thereof a duty for the same negroes to the said Arnold Elzey whilst he was and Continued Naval officer of the district af.d or to the said Levin Gale since he was appointed Naval officer of the same district did not pay but the same two negroes and Each of them and the said two pounds sterling and Every part thereof from the said Arnold Elzey whilst he was and continued Naval officer of the district af.d and from the same Levin Gale since he was appointed Naval officer of the same district and from Each of them from the time of the Importation af.d of the said Negroes to the time of the Exhibition of this Information hath kept back and unaccounted for to to the evil Example of all others in such case offending and Contrary to the form of the act of of assembly in such case lately made and provided &.cra by which and by virtue of one other Act of Assembly entituled an act for Transferring the payment of all such fines and Forfeitures as shall hereafter arise or happen upon the breach of any the penal Laws of this province to the right honourable the Lord proprietor the sum of ten pounds sterling are and became forfeited to wit five pounds sterling per poll for Each Negroe of the said two Negroes so Imported to the same Lord proprietary and the same John Scarbourough Whereupon the af.d John Scarbourough who as well for the same Lord proprietary as for himself in this part Prosecuteth as well for the same Lord Proprietary as for himself prayeth the advice of the Court here in the premisses and that the af.d ten pounds sterling to wit five pounds sterling per poll for each Negroe of the said two Negroes so Imported for the cause af.d may remain forfeited and that he the same John Scarbourough may have the half thereof and the same Lord Proprietary the other half according to the form of the act of assembly af.d in such case made and provided &.ra and also that the af.d Isaiah Bredall may come here into Court to answer of and upon the premises &.ra pledges &.ra John Doe & Richard Roe And the said Isaiah Bredall by Francis Allen his Attorney by the special favour of the Court here admitted Comes and defended the force and Injury when &.ra and prays a hearing of the Information af.d and to him it is read &ra which being read and heard the same Isaiah prays Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the af.d John Scarborough who &.ra here also &.ra Att which said next Court to wit the twentieth day of august ann.o Dom one thousand seven hundred thirty and four Came again as wel the af.d John Scarbourough who &.a by W.m Goldsborough his Attorney as the af.d Isaiah Bredall by his attorney af.d and whereupon the said ^John^ Scarborough who &.ra saith that he will no further prosecute against the aforesaid Isaiah Bredall in the premises aforesaid &.era (therefore |
