(158) Court the Writing Obligatory afd which the Debt afd in form afd doth Testify the date whereof is the day & year afd pledges &a Jno Doe & Ri Roe Whereupon the said Patrick Burk by William Beckingham his Attorney Comes and Defends the force and Injury when &a and says that he Cannot Gainsay the Action afd of the afd Peter Stewart nor Can he say but that the Writing Obligatory afd is the Deed of him the Same Patrick Burk nor but that he owes the same Peter Stewart the afd seven pounds four shillings and four pence Currant Money in Manner and form as the afd Peter Stewart above against him hath Declared wherefore the same Peter prays Judgment for his debt afd and his Damages by Occasion of the detaining of the same Debt to him to be adjudged &a Therefore it is Considered that the afd Peter Stewart Recover Against the said Patrick Burk his debt afd and his Damages by Occasion of the detaining of the same debt to One hundred 177 seventy seven pounds of Tobacco to the same Peter Stewart of his assent by the Court here adjudged and the afd deft in Mercy &a
