and avalon Lord Baron of Baltemore &a To the Justices of Somerset County Greeting altho' we Lately being willing for Certain Causes to be Certified of the tenour of the ^record and^ process of a Certain plea of Debt which was before you in Our County Court of Somerset afd betwixt John Tunstall assignee of Hugh Porter and Thomas Fletcher which the Same John Tunstall assignee as afd from the afd Thomas Fletcher demanded as it is said by our Writt to you lately did Command that the Tenor of the Record and process of the plea afd with all things thereunto relating by whatsoever Names the parties afd in the plea afd were Called before Our Justices of the prov.l Court under your seals Distinctly and Openly without delay you should send and our writt afd Nevertheless for Certain Causes us now moving the plea afd unto you we remitt that in that plea with that speed which of right and according to Law ye may proceed our writt afd to you hereto fore the Contrary Notwithstanding Wittness Levin Gale Esq.r Chiefe Justice of Our Provinciall Court the ninteenth day of October in the ninteenth Year of our dominion &a anno Dom One thousand Seven hundred and thirty three which being read and heard the said John Tunstall assignee as afd by George Douglas his attorney declared against the said Thomas Fletcher in the plea afd as followeth viz.t Somerset County ss.t Thomas Fletcher Late of Somerset County Clerk Otherwise Called the Reverend Thomas Fletcher of the same place Gent was Sumon'd to answer unto John Tunstall assignee (of Hugh Porter) according to the form of the act of assembly in such Case provided of a plea that he render unto him sixty pounds Sterling which to him he Oweth and unjustly detaineth &a And whereupon the same John by George Douglas his attorney says that whereas the afd Thomas on the twentieth day of march anno Dom Seventeen hundred and twenty three at Somerset County afd within the Jurisdiction of this Court by his Certain writing Obligatory which the said John sealed with the seal of the said Thomas herewith in^to^ Court brings whose date is the day and year afd did acknowledged himselfe to be held and firmly bound to the afd Hugh Porter Gent in the Sum of Sixty pounds Sterling to be paid to the afd Hugh Porter his heirs Executors adm.rs or assignes when he should be thereto required and whereas the afd Hugh afterwards viz.t on the thirty first day of July anno Dom seventeen hundred and thirty One at somerset County afd within the afd Jurisdiction by his Certain Writing of assignment |
