101 hath it and the same day is given to the afd James here also &a Att which said next Court to witt the twentyeth day of November anno Dom One thousand seven hundred & thirty three Came againe as well the afd James Breman as the afd Thomas Billin by their attorneys afd And because the afd James did not declare against the afd Thomas in the plea afd nor did prosecute his writt afd against the Same Thomas &a Therefore he and his pledges of prosecuting be in mercy and the plft name pledges &a and that the afd Thomas Billin go thereof without day Also it is Considered that the afd Thomas Billin Recover against the afd James Breman his damages by Occasion of the premisses to Two hundred & 264 Sixty four pounds of tobacco to the Same Thomas Billin by discretion of the Justices here at his request for his Costs and Charges in that part Sustained according to the form of the Statute thereof Lately made and provided adjudged &a * memorand.m the Bail peice should have been Entered Immediately after the return of the writt but was Omitted and Entered here as followeth viz.t Whereupon the afd Thomas Billings being Called appears and thereupon the said Thomas Billing at the prayer of the afd James Breman by his attorney afd is adjudged to give Speciall bail to the action afd thereupon a Certain John Britt of Somerset County planter present here in Court undertook for the said Tho.s Billin and assumed upon himselfe that if in Case the said James Breman should recover Judgm.t in the plea afd ^agt the said Ths Billin^ or that the said Thomas Billin should be therein Convict that then he the said Thomas Billin should pay the Condemnation of the Court thereupon or render his body to the Custody of the sher of Somerset County in Satisfaction thereof or that he the said John Britt will do the Same for him &a
Creek the third Tuesday of March ^then^ Next to Answer unto Adam Muir of a plea that they Render unto him the sum of twenty Eight pounds One Shilling & three pence three farthings [to be paid in Staves pork and Indian Corn] and four hundred and thirty Nine pounds of tobacco which to him they Owe and Unjustly detaine &a and that thereof he should not fail &a Att which said third tuesday of march to witt the twentieth day of the Same month anno Dom One thousand Seven hundred and thirty two being the day of the return of the said Writt Cometh the said Adam Muir by William Beckingham his attorney and the sher of Somerset County to whom the foregoeing writt was directed Likewise Comes and makes return thereof to |
