       June Court    1731                 94

Shall make restitution unto him the Said Robert Atkins of all or Such part thereof as Shall be so made appear
to be undue &.c or that he the Said Levin Gale will do it for him &c

             Therefore it is Considered that the afd two horses of the Value of Fifteen hundred pounds of tobacco
so as afd attached may be Condemned as of the Rights and Creditts of the Said Robert Atkins towards Satisfying
unto the Said James Shirley of the afd Sum of fourteen hundred pounds of tobacco and One pound three Shillings
and Six pence Curr.t money as also all Costs accrewing upon the writt of attachment afd and that he have thereof
Execution according to act of assembly &c

     This being an action of trespass upon the Case &.c wherein the Sher of Somerset County
to whom the writt in the Same action was directed Comes and makes Return thereof to ye
Court here Endorsed viz.t  Cepi Corpus P John Purnall sher
    Whereupon the Said John Magan being Called appears and thereupon the Said John Magan at the prayer of John
Dennis Jun.r by Levin Gale & Francis Allen his attorneys is adjudged to Give Speciall bail to the action afd

                   Thereupon a Certain Capell King of Somerset County Gent present here in Court in his proper person undertakes
for the Said John Magan that if in Case the Said John Dennis Junr Should Recover Judgm.t against the Said John Magan
in the plea aforesaid or that the Said John Magan Should be therein Convict that then he the Said John Magan Shall
pay the Condemnation of the Court thereupon or Render his body to the Custody of the Sher of Somerset County
in Satisfaction thereof or that he the Said Capell King will do the Same for him thereupon the Said John
Magan by William Beckingham his attorney appears & Imparles till next Court &c

Thomas Euchmarsh & Comp.a
     Command was Given to the Sher of Somerset County that he Should take the
             Thomas Euchmarsh and Company Late of Somerset County merchants if
they Shall be found in his bailywick and them Should safe keep so that he might
                                  have their bodys before the Justices of his Lordships County Court of Somerserset to be held at
dividing Creek the third tuesday of June then next to answer unto John Murray of a plea of trespass upon the
Case &.c and that thereof he Should not fail &c

                   And the Said John Murray by Levin Gale his attorney Complaines against the afd Thomas Euchmarsh &
Company in the plea afd as followeth viz.t

                            Somerset ss   Thomas Euchmarsh and Company Late of Somerset County Merchants were
attached to answer unto John Murray of a plea of trespass upon the Case &c

And whereupon the Same John Murray by Levin Gale his attorney Complains that whereas the afd Thomas Euchmarsh
the tenth day of may Ann Domini on thousand seven hundred and twenty
Nine at somerset county within the Jur of this court was Indebted unto the same
John Murray in the sum of twenty one Pounds Eight Shillings Currant money
as P Account hereunto Annexed and into Court brought appears and so thereof
being Indebted the said Thomas  In consideration thereof afterwards to witt
the same day and year afd at the county afd and within the afd Ju upon
himself assumed and to the said John then and there faithfully did promise
that when afterwards he should be thereto Requested he the afd sum of twenty
one pounds and Eight Shillings to the same John would well and truly
Content and Pay  Nevertheless the afd Thomas his promise and assumption
afd in forme afd made Little Regarding but Plotting and fraudulently
Intending him the same John in that Part Craftilly and Subtilly to
deceive the afd Thomas the afd sum of twenty one pounds and Eight Shill.s
