Baltemore &.c dec.d of a plea that he render unto her the full and Just quantity of fourteen hundred and forty pounds of Good sound merchantable Tobacco which from her he unjustly detains &c And whereupon the same Margaret Lady Baltemore by Levin Gale her attorney saith that whereas the aforesaid William Brereton the father whose heir the afd William Brereton the defendant is in his Lifetime the Sixteenth day of May ann.o Dom One thousand Six hundred and Eighty Eight at Somerset County afd within the Jurisdiction of this Court by his Certain Writing Obligatory granted himselfe to be firmly Indebted unto the same right honrble Charles Lord Baron of Baltemore in his life time in the afd full and Just quantity of fourteen hundred and forty pounds of tobacco to be paid the same right honrble Charles Lord Baron of Baltemore when thereto he should be required and to the making of the said payment well and faithfully the afd William the father in his Lifetime bound himselfe and his heirs by the writing Obligatory afd Nevertheless the said William in his Lifetime and the afd William son and heir of the afd William the father since the death of the said William tho' often thereto required the aforesaid quantity of fourteen hundred and forty pounds of tobacco to the afd Right honrble Charles Lord Baron of Baltemore in his Lifetime or the afd Right honrble Margarett Lady Baltemore Exrx of the Last Will and testament of the Said Lord Baron of Baltemore since his death he hath not Rendered but the Same to doe hath denyed and the afd William Son and heir of the afd William the father the same to the said Margaret Lady Baltemore to render still doth deny and unjustly detain whereby she says she is worse and hath damage to the value of two thousand pounds of tobacco and thereof she brings this suit &.c and the said Margaret Lady Baltemore brings herein to Court as well the writing Obligatory afd which the debt afd in form afd wittnesseth whose date is ye day and year afd as the Lettrs testamentary &.c by which &c L Gale P Quer pledges &c Jno Doe R Roe And the afd William Brereton by Francis Allen his attorney Comes and defends the force and Injury when &c and prays Leave thereof to Imparle here untill the next Court and he hath it and the Same day day is given to the afd Plft here also &c Att which said next Court to witt the sixteenth day of June anno Dom one thousand seven hundred and thirty Came againe as well the aforesaid Margaret Lady Baltemore as the aforesaid William Brereton by their attorneys afd and the same W.m prays further Leave thereof to Imparle here untill the next Court and he hath it and the same day is Given tot he afd Plft here also &c Att which said Next Court to witt the Eighteenth day of august anno Dom One thousand Seven hundred and thirty Came again the afd Margaret Lady Baltemore ^by her attorney afd^ and prays that the afd William Brereton son and heir as aforesaid to her declaration aforesaid May Answer but the Said William Says nothing in barr or preclusion of the action afd of the afd Marg.t by which the Same Margaret Remaineth against the afd William thereof undefended &.c Therefore it is Considered that the afd Margaret Lady Baltemore Executrix as afd Recover against the afd William Brereton son and heir as aforesaid Recover fourteen hundred and forty pounds of tobacco her debt afd and her damages by occasion 266 of the detaining of the Same debt to Two hundred and Sixty Six pounds of tobacco to the Same Margaret Lady Baltemore of her assent by the Court here adjudged and the afd deft in mercy &c |
