198 Townsend for the Sum as in the Account here with sent you Proved with the Insident Cost and Charges According to the forme of the act of Assembly in Such Case Latly made and provided and for your so doing this ^shall be^ your Warrant as Wittness my hand this 15.th day of Aprill Anno Dom 1732 Jno Scott To M.r Thomas Hayward Clerk of Somerset County Febry ye 19.th 1731 Theophilus Dennis Dr Then Came Before me Saul Towensand To paid Isaac Fleman ^for you^ by John Dennis 100 and made oath upon the holy Evanglist Errors Excepted p me Saul Towensand of Almighty God that the above account is Just and true Sworn before me Jno Scott In Pursuance to an act of Assembly of this Province now in force and in Obediance to the aforesd Warrent the folowing Attachment was Issued against ye goods and Chattells Rights or Creditts of the aforesd Theophilus Dennis the tenor whereof followeth in these words Viz.t Somerset ss Charles absolute Lord and proprietary of the Provinces of Maryland and Avalon Lord Baron of Baltemore &c To the Sher of Somerset County Greeting we Comand you that you Attach any the goods Chattells Rights or Creditts of Theophilus Dennis Late of Somerset County Planter if they shall be found in your bailywick to the Value of three hundred pounds of Tobacco and when you have the same Attached or any part thereof the Same in your Custody Safe keep so that you have the Same before our Justices of our County Court of Somerset of Somerset to be held at Dividing Creek the third tuesday of June Next then and there to be Condemned According to act of Assembly to and for the Use of a Certain Saul Towensand Unless the Said Theophilus Dennis by himself or his attorney Shall Appear and Answere unto the Said Saul Towensand in a plea of trespass upon the Case &c According to Law and that by good and Lawfull men of your bailywick you make known unto the Person or Persons in whose hands you make the Same Attachment that he she or they be and Appear before the Justices of our County Court to be held as aforesd to shew Cause if any he she or they have why the Same Goods Chattells Rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had and made According to act of Assembly in Such Case made and provided if to him her or them it Shall Seem meet and how you shall Execute this Writt that you make known unto our said Justices at the day and place aforesd and have you then and there this Writt Wittness Sam.l Hopkins Gent Chief Justices of our said Court the twenty fifth day of March in the Seventeenth Year of our Dominion &c Ann Dom one thousand Seven hundred and thirty two Att which said third tuesday of June to witt the twentyeth Day of the same month anno Dom one thousand seven hundred and thirty two being the day of the returne of the Said Writt Cometh the aforesd Saul Towensand by Francis Allen |
