271 And the afd Abraham Smith by James Shirly his attorney Comes and defends the force and Injury when &.c and the afd John prays that the afd abraham to his declaration afd may Answer whereupon the afd Abraham hath day given to him by the Court untill the third day of this term here to answer &.c at the same day the Same Abraham being solemnly Called to answer Cometh not nor the Same attorney of the afd Abraham says nothing for the Same Abraham in barr or preclusion of the action afd of the afd John by which the Same John Remaineth thereof undefended &c Wherefore the afd John Murray his damages by Occasion of the nonperformance of the promise and assumption afd against the afd Abraham Ought to Recover &.c And thereupon at the prayer of the afd John and by the Consent of the afd Abraham the Justices here according to act of assembly in Such Case made and provided do assess the damages of the Same John by Occasion of the non performance of the promise and assumption afd beyound his Costs and Charges by him about his Suit in that part Expended to Seven pounds and Seven shillings and two pence Currant money Therefore it is Considered by the Justices here that the afd John Murray Recover against the afd Abraham Smith the afd Seven pounds Seven shillings and two pence Currant Money his damages afd by the Justices afd in form 321 afd assessed as also three hundred and Twenty One pounds of tobacco for his Costs and Charges to the afd John by the Court hereof his assent adjudged and the afd deft in Mercy &c
upon a Certain Thomas Fletcher in the peace of God &.c being did make an assault and affray and him the Same Thomas Fletcher then and there did beat wound and Evill Intreat so that of his Life it was despaired and other harmes to him did to the great damage of the Same Thomas Fletcher and against the peace of the Said Thomas Fletcher Lord Proprietary his good Rule and Government &c L Gale P Lpry Test Thomas Walker James MccMorie This Bill Sent up to the grand Jury with the Leave of the Court according to act of Assembly On the back side of the foregoeing Bill of Indictment it was thus Endorsed Billa Vera Wm Selby foreman Thereupon Command was Given to the sher of Somerset County that he should Cause to Come before the Justices of his Lordship's County Court of Somerset the said William Stoughton if &.c to answer &.c and afterwards in the same Court Came the afd William Stoughton in his proper person and having heard the bill of Indictment afd Says that of the premisses afd he is guilty thereof and is willing to pay his fine for the fact afd Therefore it is Considered by the Court here that the afd William Stoughton pay to his Lordship the Lord Proprietary for his fine by the Court here upon him Imposed for and by Occasion of the trespass and assault afd whereof in form afd he is Convict fifty pounds of tobacco and that the said William Stoughton be taken to satisfie the Said Proprietary of the fine afd &c
Thereupon Command is Given to the Sherr of Somerset County that he should take the said George Horner if &c to answer &c and afterwards in the Same Court Came the Said George Horner in his proper person and being by the sher Sett to the Bar presentment Read is thereupon Instantly demanded how he would acquitt himselfe of |
