Whereupon the afd William Hopkins being Called appears and Thereupon the said William Hopkins at the prayer of the afd Edmond Hough by Levin Gale his attorney is adjudged to give Speciall bail to the action afd Thereupon a Certain Abraham Owten of Somerset County planter present here in Court undertakes for the said William Hopkins that if in Case the said Edmond Hough shall recover Judgmt in the plea afd against the afd William Hopkins or that the said William Hopkins shall be therein Convict that then he the said William Hopkins shall pay the Condemnation of the Court thereupon or render his body to the Custody of the sher of Somersett County in Satisfaction thereof or that he the Said Abraham Owten will do it for him Thereupon the said William Hopkins by by fran: Allen his attorney appears and Imparles till next Court &c
Collins her Executors administrators or assigns to the which payment well and truely to be made we bind us and Every of us our and Every of our heirs Executors and adm.rs Joyntly and severally in and for the whole firmly by these presents sealed with out Seals and dated the 22d day of aprill anno Dom 1729 The Condition of the above Obligation is Such that whereas the said Commissary Generall hath transmitted into this Court the account of the Estate of Thomas Collins dec.d wherein it is found that there is due to the abovesaid Orphan the Sum of Six pounds Eight Shillings and four pence if therefore the said Thomas Collins John Evans or Martin Kinnett or any of them or either of their heirs Executors or administrators shall well and truely pay or Caus to be paid unto the afd Orphan the afd Sum of Six pounds eight Shillings and four pence to be paid her according to act of assembly in Such Case made and provided when she shall attain at full age to receive the same &.c then the above obligation to be ^void Els to remain in^ of full force and vertue Thomas Collins (S) Sealed & Delivered in presence of Jno Evans (S) Edmond Hough Martyn Kennett (S) Thomas Hayward In pursuance of an Order of Somersett County Court to me directed to lay out a road Convenient from Corys folly to Isaiah Bredalls which I have appointed to goe along ye road Newly marked by the Inhabitants to remain as a road for ye people being in my opinion ye most convenient for every body and to ye Least prejudice wittness my hand aprill 17: 1729 Wm Fasitt |
