(409)   of the premisses afd as also the Sume of                                                                            pounds of
tobacco by the Court here adjudged unto him for his Costs and Charges in this behalfe Laid out & Expended
& the said Joseph McClester in Mercy &c

 This being an action of Debt for one thousand seven hundred and Ninety five pounds

of tobacco wherein the Sherr of Somersett County to whom the Writt in the same
                               action was directed makes Return thereof Endorsed Cepi Corpus p Joseph McClester Sherr

                   Whereupon the said Joseph Allen being Called appears and thereupon the said Joseph Allen at
       the pray of the Plfts attorney is adjudged to give Speciall Bail to the action afd but for want
       thereof the Said Joseph Allen is Committed into the Custody of the Sherr of Sommersett County there
       to remaine &c the said Sherr Present herein Court took Charge of the Said Joseph Allen accordingly
             thereupon day is given unto the said Joseph Allen in Custody as afd untill next Court and the
       same day is given to the afd plft also               Att which said Next Court to witt the fifteenth day of June
       anno Dom one thousand seven hundred and twenty five Came againe as well the afd plft by his attorney
       and the Sherr of Somersett County into whose Custody the said Joseph Allen was Committed for the
       Cause afd and thereupon the said Sherr return's a Certain Bail Peice which follows in these words vizt
       William Jones Plft ag.t Joseph Allen deft.   You Robert Weare do undertake for the said Joseph
       Allen deft in the sum of three thousand five hundred ^& Ninty^ pounds of tobacco to be Levied of Your Lands
       and tenements goods and Chattells to the use of the said William Jones plft upon Condition that if the
       said William Jones plft do obtain Judgm.t in an action of Debt for one thousand Seven hundred ^ninty five^ pounds
       of tobacco depending in Somersett County Court against the said Joseph Allen the deft that then the said
       Joseph Allen shall pay the Condemnation of the Court thereupon or deliver himselfe to the Custody of the
       Sherr of Somersett County in satisfaction thereof or you will do it for him he acknowledged himselfe to be
       Content therewith this 20.th day of march anno Dom 1724/5                                          Sam.ll Hopkins
       To the Worshipfull Justices of Somersett County Court                                                   Jn.o Purnall

          thereupon the afd William Jones by his attorney declared against the afd Joseph Allen in the plea afd
       as followeth viz.t   Somersett fs   Joseph Allen Late of Somersett County planter al.s dict Joseph
       Allen of Somersett County in the province of maryland planter was summoned to answer unto William
       Jones of a plea that he render unto him the full and Just Sum of seventeen hundred and Ninety five
       pounds of tobacco which to him he Oweth and unjustly detaineth &c

And whereupon the same William by Levin Gale his attorney Saith that Whereas the afd Joseph the
       twenty fourth day of December Seventeen hundred and twenty three at the County afd within the Jurisdiction
       of this Court by his Certain Writing Obligatory granted himselfe to be held and firmly
