parish in Somersett County Planter was attached to answer unto Henry Toadvine of a plea
of trespass upon the Case &c

          And whereupon the same Henry p George Dashiell his attorney Complains that whereas
the said John in the Year of Our Lord One thousand Seven hundred and twenty four
at Stepney Parish within the Jurisdiction of this Court was Indebted unto the same
Henry in the Sum of Nine pounds six shillings and six pence Curr.t money of maryland
as p acco.t hereunto annexed may in Court appear and being so thereof Indebted as afd
at the time and place afd for and in Consideration afd did upon himselfe assume and to
the said Henry then and there did faithfully promise that he the afd sum of Nine pounds
Six Shillings and Six pence he would well and truely Content and pay and altho' three
pounds thirteen shillings and Eleven Pence percell of the said debt the afd John hath
paid yett as to the Residue being five pounds twelve shillings and seven Pence to the said
John tho' often thereto Requested hath not paid nor in any ways Contented but the same
to do hitherto hath denyed and Still doth deny and Refuse to the damage of the said Henry
of Eleven Pounds five shillings and two pence and thereof he bringeth this Suite

    A Copy of the foregoeing declaration and account were made and sent to be served on the deft
    with the writt in the Plea afd &a

          Att which said third tuesday of March to witt the twenty first day of the same month
    Ann.o Dom One thousand seven hundred and twenty six being the day of the Return
    of the said writt Cometh the afd Henry Toadvine by his attorney afd and the sherr of
    Somersett County to whom the foregoeing writt was directed Cometh and maketh Return
    thereof to the Court here Endorsed in these words vizt Cepi Corpus decl delivered in time
                                                                                                                Francis Allen sher

    And the afd John Holder by Levin Gale his attorney Comes and defends the force and
    Injury when &.c And says that he did not assume upon himselfe in manner and form as the
    the Plft against him hath Complained and of this he putts himselfe upon the Country &c
                and the Plft in Like manner

        Thereupon Command was given to the sherr of Somersett County that Immediately
