173 Sherr further day is given unto the Said Sherr untill next Court to bring in the afd Thomas Billin to answer &.c and the same day is given unto the afd Plft also Att which said next Court to witt the sixteenth day of August anno Dom one thousand seven hundred and twenty six Came againe as the afd William Stephens Howard by his attorney afd and Likewise the Sherr of Somersett County Cometh and Bringeth into Court the afd Thomas Billin to answer unto the afd William Stephens Howard in the plea afd and thereupon the said Thomas Billin in his Own proper person defends the force and Injury when &c and says that he Cannot gainsay the action of the afd William Stephens Howard nor but that he Oweth the afd William the afd thirteen pounds Eight Shillings and four pence Current money in manner and form as the Same William above against him hath Complained &c Therefore it is Considered by the Court here that the afd William Stephens Howard Recover against the afd Thomas Billin as well the Sum of thirteen pounds Eight Shillings and four pence Curr.t mony his debt afd as also the Sum of Two hundred & forty three 243 pounds of tobo for his damages which he Sustained as well by occasion of the detaining of the Same debt as for his Costs and Charges by him about his Suit in that part Expended to the Same plft by the Court hereof his assent adjudged and the afd deft in mercy &c Memorand.m the plft ^by his attry^ releaseth the penalty reserving the principall Debt and Interest untill payment Likewise the afd Plft by his said attorney freely herein Court remitteth to the afd Thomas Billin four pounds two Shillings and Six pence out of the principall due to the afd plft Therefore the same Thomas Billin of the same four pounds two shill and six pence be thereof acquitt &c
& twenty five Six was Indebted to y.e same John in y.e sum of two pounds five shills & two pence Currant money as P.r acc.t hereunto anext may in Court appear & being soe thereof Indebted y.e said Jacob did upon himselfe assume & promise yt y.e afd Sum of two pounds five Shill.s & two pence he would well & truly pay when thereto requested Nevertheless y.e same Jacob his promise ad in forme afd Made he hath Not regarded but y.e same two pounds five Shill.s & two pence to pay hath Denyed & Still doth Deny to y.e Damage of y.e said John of four pounds ten Shill.s & four pence & thereof he brings Suite &c Dashiell P Quer pledges &c J: Doe R: Roe |
