      John Bishop Late of Somersett County Planter was attached to answer unto
  Joseph MccClester of a plea of trespass upon the Case &c
                         And Whereupon the Same Joseph MccClester by Levin Gale his attorney Complains that
       Whereas the Said John the Eighteenth day of Novem anno Dom One thousand Seven hundred and
       twenty five at Somersett County within the Jurisdiction of this Court was Indebted unto the Said Joseph
       in Fourteen hundred & Seventy Eight pounds of tob.o for Levies Officers Fees & forbarances
       thereupon to ye said Joseph then & there due oweing & unpaid as by acc.o thereof hereinto
       Court annexed may in Court appear & being so thereof Indebted ye Said John afterwards
       to witt ye day & year afd at ye place afd in Consideration thereof upon himselfe did assume & to
       The said Jos: then & there did faithfully promise yt he ye said John ye afd fourteen hundred
       & seventy Eight pounds of tob.o to ye Said Jos: when he should be afterwards thereunto
       requested he would well & faithfully pay & Content altho ye said John Nine hundred and
       forty Eight pounds of tob.o percell of ye afd fourteen hundred & Seventy Eight pounds of
       tob.o to ye said Joseph he hath paid & satisfied yett as to five hundred & thirty pounds of
       tob.o in form afd ye said John his promiss & assumption afd in form afd made Little regarding
       but Plotting & fraudulently Intending ye same Jos: in yt part Craftilly & subtilly to
       Deceive & defraud ye afd five hundred & thirty pounds of tob.o to ye said Joseph he hath
       not paid or to him for ye Same in any wise Contented altho the same to doe ye said John
       by ye same Jos: in ye first day of august anno Dom one thousand seven hundred & twenty
       five & often afterwards at ye County afd within ye Jur of this Court was thereunto requested
       but the same to him to pay or in anywise to Content hath altogether refused & still doth
       refuse & Deny Whereupon ye Said Jos: Saith he is worse & hath damage to ye value of one
       thousand sixty pounds of tob.o & thereof he brings this Suite &c
