             Paid or to him for the same in any wise Contented altho' the same to do the said John by the said Robert on the
             first day of December in the year afd and Often afterwards at ye Parish and County afd within the Jurisdiction
             afd he was thereunto requested but the same to him to pay or in any wise to Content hath refused and still doth
             refuse and deny whereupon ye said Robert Saith he is worse and hath damage to the value of One thousand
             One hundred and seventy six pounds of tobacco and thereupon he Brings Suite &.c

                                                                                                                            Errors Excepted p me   Rob.t Martin
                                  Att Which said third tuesday of March to witt the ninteenth day of the same month Ann Dom
                One thousand seven hundred and twenty two Being the day of the return of the said Writt Comes the said Robert
                Martin by his attorney afd and the Sherr of Sommersett County to whom the foregoing writt was directed Likewise
                Comes and makes return thereof to ye Court hee Endorst in these words viz.t  Copie Jos: MccChester Sherr

                                 Whereupon the said John Barcley in his Own Proper person Comes and defends the force and
                Injury when &.c and says that he Cannot gainsay the Plft his action afd so as afd against him Brought nor
                Can he say but that ye said Plft Ought to recover his damages by Occation of the Premisses afd to the sum of
                four hundred Eighty Eight pounds of tob.o and Costs of suite against him which ye said Plft doth not gainsay
                                Therefore it is Considered by the Justices hee the same day and year Last mentioned that the
                said Robert Martin Recover against ye said John Barcley as well the sum of four hundred and Eighty
                Eight pounds of tobo Certain damages afd in forme afd Confesed as also the sum of Two hundred and forty Eight
Costs 24                              Pounds of tob.o and Cost of Suite against him by the Court here adjudged unto him for his
                Costs and Charges by him about his suite in this Behalfe Laid Out and Expended and ye Deft in mercy &.c

 This being an Action of trespass upon the Case &.c wherein the Sheriffe of Somrsett County to
 
whom the writt in the same action was directed Comes and makes return thereof to the Court here
                   Endorst in these words viz.t                                    Cope Jos: MccChester Sherr
                                                                Whereupon the said Daniel Sharradon being Called appears and thereupon
                the said Daniel Sharradon at the Prayer of Robert Martin by his attorney is adjudged to give Speciall Baile
                to the action afd thereupon a Certain William Young of Somrsett County Planter Present herein Court undertakes
                for the said Daniel Sharradon that in Case the said Robert Martin shall Recover Judgm.t in the Plea
                afd against ye said Daniel Sharradon or that ye said Daniel Sharradon shall be therein Convict that then
                he ye said Daniel Sharradon shall pay ye Condemnation of the Court thereupon or render his Body to ye
                Custody of the Sherr of Somrsett County in Satisfaction thereof or that he the William Young will do it for him
                thereupon the said Daniell Sharradon in his own proper person appears & Impeals till next Cort
