   pounds of Tobacco In Consideration thereof the afd Deft afterwards vizt. ye day
   & month & year afd at the Parish County & Jurisdiccõn afd upon himselfe —
   assumed & to the Said Plt then and there faithfully promised that he the Sd
   Deft the afd Sum of eight hundred pounds of Tobacco when thereunto
   required would well & truly pay & Content Nevertheless the afd Deft his
   promise and assumption afd in no wise regarding but plotting & fraudulently
   Intending the afd Sum of Eight hundred pounds of Tobacco to deceive &
   defraud he hath not minded or regarded But the afd Sum of Eight hundred
   pounds of Tobacco to the afd Plt altho’ often required he hath not rendered
   but that to him to render hitherto hath denied to the damage of the Said
   Plt. one Thousand pounds of Tobacco & thereupon he brings Suite &ca

   Zachariah Browne of Kent County Planter here present in Court undertakes
   for the afd Hugh Frezier that in Case the Said Richard Cole Admr of the
   afd Renatus Smith Shall Recover Judgment in the plea afd against
   the Said Hugh Frezier or that the Said Hugh Frezier Shall be therein
   Convict that then he the Said Hugh Frezier Shall pay the Condemna:
   :tion of the Court thereupon or render his body to the Custody of the Sherf
   of Said County in Satisfaccõn thereof or that the Said Zachariah Browne
   will do it for him
      and now at this Court to wit the 15th day of March Anno Domi 1719
   here present the Said Deft comes and defends the force and injury when &ca.
   and Says that he cannot gainsay the Plt his accõn afd So as afd agst. him
   brought nor can he Say but that the Said Plt ought to Recover his —
   Damages by Occation of the Premises afd to the Sume of Eight hundred
   pounds of Tobacco and Cost of Suite but that Execution may be Stayed —
   untill the tenth day of November next Ensuing which the Said Plt does
   not gainsay Therefore it is Considered by the Justices here the 15th
   day of March Anno Domi 1719 afd That the Said Richard Cole Admr. as
   afd Recover against the Said Hugh Frezier as well the Sume of Eight
   hundred pounds of Tobacco Damages afd in forme afd Confessed as also the
   Sume of Two hundred Sixty Three pounds of Tobacco by the Court here adjudged
   to him for his Costs and Charges about his Suite in this behalfe expended
   and the Deft. in mercy &ca.
     But that Execution of the Judgment afd Cease as afd untill the tenth
   day of November next Ensuing
