   Gilbert Higginson | Kent County in Maryland Ss John Clayton of
           ——– | Kent County Planter was Attached to Answer
              at | unto Gilbert Higginson of A Plea of Trespass
   John Clayton       | on the Case and whereupon the afd Plt by
   David Macbride his attorney Complaines that Whereas the afd Deft the —
   fourteenth day of June in the Year of our Lord Christ one Thousand Seven hundred
   and Seventeen at Shrewsberry Parish in Kent County & within the Jurisdicion
   of this Court In Consideration that the afd Plt at the Special Instance and
   Request of the afd Deft had then and there paid unto a Certain Philip Pearce
   and to the Proper use and behoofe of the afd Deft the Sume of Eleven
   hundred pounds of Merchantable Tobacco in an Account hereunto Annexed
   Sett forth upon himselfe assumed and to the Said Plt then and there faithfully
   promised that he the Said Deft the afd Sum of eleven hundred pounds of
   Merchantable Tobo. unto the Said Plt when thereunto required would well and
   truly pay and Content and that Whereas also the afd Deft afterwards vizt.
   the Thirteenth day of August in the Year afd at the parish & County afd & within
   the Jurisdiciõn afd In Consideration that the afd Plt at the Like Special Instance
   and request of the afd Deft had then and there Last mentioned Sold and delivered
   unto the afd Deft & to the proper use & behoofe of the afd Deft Divers goods
   wares & Merchandizes at the Several Rates and Prices in an Accot hereto Annexed
   Sett forth in the whole Amounting unto the Sum of one hundred and Nineteen
   pounds of Merchantable Tobacco upon himselfe assumed and to the Said Plt
   then and there last mentioned faithfully promised that he the Said Deft the
   afd Sum of one hundred and nineteen pounds of Merchantable Tobacco unto
   the Said Plt when thereunto required would well and truly pay and Content
   and that whereas also the afd Deft afterwards viz the afd Thirteenth day of
   August in the Year afd at the Parish and County afd & within the Jurisdiciõn afd
   In Consideration that the afd Plt at the like Special Instance & request of
   the afd Deft had Sold and delivered to the afd Deft and to the proper use & behoofe
   of the afd Deft diverse Goods wares and Merchandizes in an Accot. hereunto
   Annexed Particularly Sett forth upon himselfe assumed and to the Said Plt then
   and there last mentioned faithfully Promised that he the Said Deft So much Merchan:
   :table Tobacco as the afd Goods wares & Merchandizes Sold and delivered as afd at the
   time of the Sale and delivery of the Same were reasonably worth to the Said Plt
   when thereunto afterwards he Should be required would well and truely pay and
   Content and the afd Plt Indeed Saith that the afd Goods wares & Merchandizes at
   the afd time of their Sale & delivery at the Parish & County afd & within the
   Jurisdiciõn afd at reasonable Rates & Prices were worth & amounted to the
   Sum of one hundred & Nineteen pounds of Merchantable Tobacco in manner
   as in the Said Account is Sett forth of which the Said Deft then and there
   last mentioned had Notice and whereas also the afd Deft afterwards vizt.
