Saunders of Kent County Planter if he Should be found in his bailywick & him Safe keep So that he have his body before his Said Lord Ships Justices of the next Court to be held at our Court house in the Town of Chester in Said County to Answer unto Richard Bennett of a plea that he render to him ye Sum of Eleven Thousand Six hundred & two pounds of good Sound Merch: :antable Tobacco Clear from all Spotted Moultered trashi or ground Leaves in Cask of ye value of Forty nine pounds Sterling money which he unjustly detains &ca. And that he have then and there the Said writ &ca Att which Said next Court vizt. the Seventeenth day of March the Same year last mentioned the day of return of Said writ came Simon Wilmer Gent. high Sherf of Said County and made return thereof in these words thereon endorsed as folls vizt. Cepi Corpus pr S:Wilmer Sherf And A Declaration being filed when Said writ Issued forth and a Copy thereof Served therewith according to Act of assembly in Such Case made was as folls vizt. Kent County Ss George Sanders of Kent County in the Planter was Summoned to Answer unto Richard Bennett of a plea that he render to him ye Sum of Eleven thousand Six hundred & two pounds of good Sound Merchantable Tobacco Clear from all Spotted moultered trashi or ground Leaves in Cask of the value of forty nine pounds Sterling money which he unjustly detains &ca. And whereupon the afd Plt by Thomas Bowne his attry Saith that whereas the afd Deft the thirtieth day of July in the Year of our Lord Christ Seventeen hundred and nine at St. Pauls Parish in Kent County afd within the Jurisdicion of this Court by his Certain bill obligatory which the Said Deft Sealed with his Seale and as his deed delivered hereinto Court brought the date whereof is the Same day and Year afd bound and obliged himselfe~ his heires Executors & Admrs in the afd Sum of Eleven Thousand Six hundred & two pounds of good Sound Merchantable Tobacco Clear from all Spotted Moultered trashi or ground leaves in Cask of the afd value of forty nine pounds Sterling money for the true payment of the full and Just Sum of five thousand Eight hundred and one pounds of like Tobacco Qualified as afd and cask to Contain ye Same to the afd Plt his Exrs. Admrs. or assigns upon the tenth day of 8ber. next ensuing the date of the Said bill Convenient on the Said Defts then dwelling plantation And the Said Plt in deed Saith that the afd Deft hath not paid to the afd Plt the afd five Thousand Eight hundred & one pounds of Tobacco upon the afd tenth day of 8.ber which to him (at or) upon the Same day he ought to have paid according to the forme and Effect of the bill |
