he have his body before his Said Lordships Justices of the next Court to be he[ld] at our Court house in the Town of Chester in Said County to Answer unto James Harris of a plea of Trespass of ye Case And that he have then and there the [Said] writ &ca. . . Att which Said next Court vizt. the Eighteenth day of March the Same Year last mentioned the day of return of Said writ came Simon Wilm[er] Gent~ high Sherf. of Said County and made return thereof in these words thereon endorsed as folls. vizt. Cepi Corpus pr Simon Wilmer Sherf- And A Declaration being filed when Said writ Issued forth and a Copy - thereof Served therewith according to Act~ of assembly in Such case made was as folls vizt. Kent County Ss Francis Scott of Kent County Planter Stands attached to Ans[wer] unto James Harris of a plea of Trespass of ye Case . . . And Whereupon the afd [Plt] by Thomas Bowne his attry: Complaineth for that whereas the afd Deft~ the twelth day of November in the Year of our Lord Christ~. One Thousand Seven[teen Hundred] and Sixteen at St~. Pauls Parish in Kent County within the Jurisdiciõn of this [Court In ] Consideration that the afd Plt~. at ye Special Instance & request of the afd Deft~ had then and there Sold and delivered unto the afd Deft~ and to the proper use~ and behoofe of the afd Deft~ divers goods and Merchandizes at the Severall Rates and prices in an Account hereunto Annexed Specifically Sett forth which in the [whole] amounts unto the Sume of one Thousand & fifty three pounds of Merchantable Tobacco upon himselfe assumed and to the Said Plt~. then & there faithfully [promised] that he the Said Deft~ the afd SUmm of one Thousand & fifty three pounds of— Merchantable Tobacco unto the Sd Plt~ when thereunto required would well and [truly] pay & Content~ and that whereas also the afd Deft~ afterwds vizt. the afd twelth day of~ November in the Year afd at the Parish County and Jurisdiciõn afd In Consideration— that the afd Plt~. at the like Special Instance & request of ye. afd Deft~ had then and - there last mentioned Sold and delivered unto the afd Deft~ and to the proper use and behoofe of the afd Deft~. diverse goods and Merchandizes as in Said Account Sett forth- upon himselfe assumed and to the Said Plt~. then and there last~. mentioned faith[fully] promised that he the Said Deft~ So much Merchantable Tobacco as the afd last ment[ioned] goods and Merchandizes Sold and delivered as last Said at the time of the Sale and delivery thereof at reasonable rates & prices were worth and Amounted to unto the Said Plt~. when thereunto required would well and truly pay & Content~ and the afd Plt~ indeed Saith that ye afd last mentioned goods and Merchandizes Sold and [delivered to ye Plt afore] Said at the time of the Sale and delivery thereof at reasonable rates and prices [were] worth and Amounted unto the Summ of one Thousand and fifty Three pounds of Merchan[:] :table Tobacco in manner and form as in the Said Account~ Sett forth of which the Said Deft~. then and there last~ mentioned had Notice Nevertheless the afd Deft his Severall [promises and assumptions] afd in forme afd made as to the afd [Summs?] |
