179 In case the Court of Appeals should affirm the Judgment of the County Court of Anne Arundel as aforesaid In this state to be holden in the City of Annapolis in the State House the usual place and upon the term appointed by law &.c In witness whereof I the said Samuel Smith have hereunto set my hand and affixed my seal this Thirteenth day of may in the year of our Lord one Thousand Eight hundred and Forty Two Signed sealed and delivered in the presence of Sam.l Smith (seal) Lewis Sutton S.r David P Smith At the foot of the aforegoing was thus written to wit State of maryland Anne Arundel County to wit On this 13th day of may 1842 before me one of the Justices of the peace in and for the state and County aforesaid appeared Samuel Smith of the said County and state as aforesaid and acknowledged the foregoing Instrument of writing to be his act and deed according to the true Intent and meaning of thes ame and the act of assembly in such a case as made and provided Exd d d Witness my hand doen before Lewis Sutton Sr chd 5½ Recorded the 28th day of May 1842 Know all Men by these presents that I David M Brogden of Anne Arundel County for the purpose of securing payment of the Draft hereinafter mentioned and in consideration of the sum of one dollar Current money to me in hand paid by James Iglehart of hte City of Annapolis at or before the sealing and delivery of tehse presents the receipt whereof is hereby acknowledged have granted bargained and sold and by these presents do grant bargain and sell unto teh said James Iglehart his Executors administrators and assign the following negroes slaves for life that is to say Peter aged twenty two years Wilson aged twenty years John aged seventeen years and Anne aged fifteen years which said negroes are now in my possession To have and To hold said negroes unto and to the use of hte said James Iglehart his Executors adminsitrators and assigns forever provided however that if the said Davis M Brogden his Executors administrators shall well and truly discharge and retire at the maturity the draft of the said David M Brogden on Thomas J Hall in favor of the said James Iglehart for teh sum of one thousand dollars dated on the second day of June in the year Eighteen hundred and forty two and payable four months after date thereof which said draft has been accepted by the said Thomas J Hall and endorsed by the said James Iglehart for accommodation of the said David M Brogden and shall well and truly indemnify and save harmless the said James Iglehart his executors and administrators from all damage Costs and charges by reason of said endorsement then these presents and every thing herein contained shall be null and void and it is hereby further granted |
