173 acknowledged the aforegoing deed or instrument of writing to be his act & deed for the purposes therein mentioned according to the purport true intent and meaning of the said deed or instrument of writing Acknowledged before and Certified by chd Wm Glover 87 7½ Recorded the 16 day of April 1842 Know all men by these presents that I Richard Swann of the City of Annapolis for and in consideration of the sum of five dollars Current money to him in hand paid by Robert W Kent and Basil Sheppard at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have granted bargained and sold and by these presents do grant bargain and sell unto the said Robert W Kent and Basil Sheppard their executors administrators and assigns a negro boy Jim aged years now in my possession and all my individual household furniture To have and To hold the aforesaid negro and furniture unto the said Robert W Kent and Basil Sheppard their executors administrators and assigns upon the trusts following that is to say in trust that the said Robert W Kent and Basil Sheppard their Executors or administrators shall and may sell the personal property hereby bargained and sold at public or private sale and for Cash or on credit as they may deem expedient And the proceeds thereof after satisfying the Costs and expenses attending the Execution of this trust apply to the payment of a Debt due and owing from the said Richard Swann to one Tilghman Scyhle on the joint and several obligation of the said Richard Swann Robert W Kent and Basil Sheppard dated on the sixteenth day of July in the year one thousand Eight hundred and thirty nine for payment of the sum of one thousand dollars with interest and of one other Debt due from the said Swann on the promissory note of said Swann endorsed by John S Selby William Brewer and James H Iglehart and discounted at said Bank for the sum of four hundred dollars dated on the thirteenth day of april in the present year and payable sixty days after ^the^ date thereof and the surplus proceed of said if any and the property remaining unsold if any after payment and satisfaction of said debts To hold to and for the use and benefit of the said Richard Swann his Executors administrators and assigns provided Nevertheless that if the said Richard Swann his Executors or administrators shall at any time before the first day of January in the year Eighteen hundred and forty pay unto the said Tilghman Scyhle his Executors administrators and assigns the principal Debt and interest due and owing on the aforesaid described obligation and unto the said President Directors and Company of the Farmers Bank of Maryland the debt or sum of money due and owing on the aforesaid promissory note then and in such case (these) |
