(B) RESTRICTIONS ON ASSIGNMENT OR TRANSFER OF PROPERTY.
AN APPLICANT MAY NOT ASSIGN OR TRANSFER PROPERTY TO ESTABLISH
ELIGIBILITY FOR ASSISTANCE UNDER THIS PART DURING THE 3 YEARS BEFORE:
(1) FILING AN APPLICATION FOR ASSISTANCE; OR
(2) RECEIVING ASSISTANCE.
REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 88A, § 65(e) and, as it related to eligibility
requirements, (a).
In the introductory language of subsection (a) of this section, the reference
to a resident being "eligible for assistance under this part" is added for
clarity.
In the introductory language of subsection (b) of this section, the phrase "to
establish eligibility" is substituted for the former phrase "for the purpose of
rendering himself eligible" for brevity.
Also in the introductory language of subsection (b) of this section, the
phrase "during the 3 years before" is substituted for the former phrase "at
any time within 3 years immediately prior to" for brevity and clarity.
In subsection (b)(2) of this section, the former phrase "pursuant to the
provisions of this article" is deleted as surplusage.

5-404. APPLICATION FOR ASSISTANCE.
(A) APPLICATION FOR ASSISTANCE.
AN APPLICATION FOR ASSISTANCE UNDER THIS PART SHALL BE MADE:
(1) TO THE LOCAL DEPARTMENT OF THE COUNTY WHERE THE
APPLICANT RESIDES; AND
(2) IN THE FORM AND MANNER THAT THE ADMINISTRATION REQUIRES.
(B) RECORD OF APPLICATION.
WHENEVER A LOCAL DEPARTMENT RECEIVES AN APPLICATION FOR
ASSISTANCE UNDER THIS PART, THE LOCAL DEPARTMENT SHALL MAKE A RECORD
OF:
(1) THE CIRCUMSTANCES OF THE APPLICANT;
(2) THE FACTS SUPPORTING THE APPLICATION; AND
(3) ANY OTHER INFORMATION THAT THE ADMINISTRATION REQUIRES
BY REGULATION.
