Section 2-309(i)(1)(viii)

Annotated Code of Maryland

(2002 Replacement Volume and 2003 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section(s) 2-309(i)(1)(viii) of Article - Courts and Judicial
Proceedings of the Annotated Code of Maryland be renumbered to be Section(s)
2-309(i)(1)(ix).

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

Article - Courts and Judicial Proceedings

2-309.

(i) (1) (iii) 1. The Sheriff shall appoint a chief deputy sheriff, a
community adult rehabilitation center administrator, a detention center director, a
detention center deputy director, a law enforcement director, law enforcement
personnel and a personal secretary to the Sheriff!, who shall serve at the pleasure of
the Sheriff].

2. The Sheriff may remove the chief deputy sheriff,
community adult rehabilitation center administrator, detention center director,
detention center deputy director, law enforcement director, and personal secretary to
the Sheriff at any time whether or not for cause.

(vii) Except for the chief deputy sheriff, community adult
rehabilitation center administrator, detention center director, detention center deputy
director, law enforcement director, law enforcement personnel, and personal secretary
to the Sheriff, all employees of the Sheriff's department:

1.       Shall be governed by the rank, salary, and benefit
structures of the Cecil County personnel policy; and

2.       [Upon] EXCEPT AS PROVIDED IN SUBPARAGRAPH (VIII)
OF THIS PARAGRAPH, UPON completion of the probationary period, shall be subject to
the Cecil County personnel regulations and policies in all matters.

(VIII) LAW ENFORCEMENT OFFICERS AND CORRECTIONAL OFFICERS
OF THE SHERIFF'S DEPARTMENT MAY BE TERMINATED ONLY FOR JUST CAUSE.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 2004.
