Ch. 407                                    2004 LAWS OF MARYLAND

(1)     one member of the Washington County Delegation, appointed by the
members of the Washington County Delegation;

(2)     the President of the Washington County Board of County
Commissioners, or the President's designee;

(3)     the Mayor of the City of Hagerstown, or the Mayor's designee;

(e)     The Chairman of the Commission will be appointed by the Chairman of the
Washington County Delegation from among the 21 voting members serving on the
Commission.

(f)      (1) The Commission shall consist of the following four work groups:

(i)     the facilities and organization work group;

(ii)    the debt, finance, and accounting structure work group;

(iii)   the legal issues and labor relations work group; and

(iv)    the planning and environmental work group.

(2) (i) The Chairman of the Commission shall determine the
membership of each work group.

(ii) A work group leader shall be elected by the voting members
appointed to that work group.

(g)     The Washington County Board of County Commissioners, and the City of
Hagerstown, and the Department of the Environment shall provide the staff for the
Commission.

(h) The responsibilities of the Commission include:

(1)     assessing the existing capacity and deficiencies of the water and
sewer services in Washington County;

(2)     reviewing the State and federal regulatory requirements with regard
to providing water and sewer services;

(3)     reviewing and analyzing the future growth projections for
Washington County, and the impact that growth will have on water and sewer
services throughout Washington County;

(4)     examining the water and sewer services provided by neighboring
regions and other counties and municipalities throughout the State;

(5)     considering various options as to how future water and sewer
services can be achieved in an efficient and cost effective manner, while ensuring that
the system will continue to service public health needs of the residents of Washington
County;
