Legislative Resolution 01-09
Resolution of the Town of University Park, Maryland, pursuant to the authority
of Article XI-E of the Constitution of Maryland and Section 13 of Article 23A of the
Annotated Code of Maryland, as amended, to amend certain provisions of the Charter
of the Town of University Park, by repealing and re-enacting Article III, Section 308,
"vacancies in Office" and Article V, Section 507, "Special Elections or Appointments
Where There Are No Qualifying Candidates", to change the manner in which
vacancies in office are filled. Specifically, the amendments provide that, when a
vacancy occurs in the office of Mayor or Council, and there are 120 or more days
remaining in the term of office, then a special election will be held to fill the seat, and
the Board of Election Supervisors is directed to set that election. If less than 120 days
remain in the term, then the seat will be filled by appointment.
