AN ACT concerning
State Police Retirement System - Retirees - Reemployment as Sheriffs or
State's Attorneys
FOR the purpose of exempting certain members of the State. Police Retirement
System from a prohibition that members of the State Police Retirement System
cannot accept a retirement or pension allowance from another pension or
retirement system supported wholly or in part by the State; providing for the
application of this Act; and generally relating to an additional retirement or
pension allowance for members of the State Police Retirement System.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - State Personnel and Pensions
24-406.
(a) A member may be entitled to benefits under Title 29 of this article other
than, or in addition to, the service retirement benefits provided under this subtitle.
(b) (1) THIS SUBSECTION DOES NOT APPLY TO AN INDIVIDUAL WHO IS:
(I) RECEIVING A SERVICE RETIREMENT ALLOWANCE OR A VESTED
ALLOWANCE FROM THE STATE POLICE RETIREMENT SYSTEM; AND
(II) SERVING AS A SHERIFF OR STATE'S ATTORNEY FOR A COUNTY
THAT IS A PARTICIPATING GOVERNMENTAL UNIT.
(2) A member is not entitled to receive a pension or retirement allowance
from another pension or retirement system supported wholly or in part by the State.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall be
construed retroactively and shall be applied to and interpreted to affect any
individual who was serving as a sheriff or State's Attorney on or after January 4, 1999
and is serving in that same position on July 1, 2002.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1, 2002.
|
