Also in subsection (a) of this section, the defined term "correctional
facilit[y]" is substituted for the former reference to "penal and reformatory
institutions" for consistency throughout this article. See General Revisor's

In subsection (d) of this section, the reference to the "State" budget is
added to state expressly that which only was implied in the former law,
i.e., the Division's funds are appropriated in the State budget,

3-222. EXPENSES.

THE EXPENSES RELATING TO GUARDING, LODGING, FEEDING, CLOTHING, AND
CARING FOR AN INMATE WHO HAS BEEN SENTENCED TO THE JURISDICTION OF THE
DIVISION OF CORRECTION MAY NOT BE ASSESSED AGAINST, BILLED TO, OR PAID BY
A COUNTY.

REVISOR'S NOTE: This section is derived without substantive change from
the third sentence of former Art. 27, § 76.

The reference to an inmate who is sentenced to "the jurisdiction of the
Division of Correction" is substituted for the former reference to an inmate
who is sentenced to "any State institution" for consistency with § 9-103 of
this article.

The reference to the county "where such person was indicted" is deleted for
accuracy. Allegations that an individual has committed a crime may be set
forth in an information, a citation, or a statement of charges as well as an
indictment. See Md. Rule 4-102. This deletion also clarifies that no county
may be charged for the specified expenses, regardless of where the
charging document was filed. These types of expenses are paid by the
State, as set forth in the annual State budget.

The former phrase "irrespectively of whether or not the judgement, upon
which such sentence is imposed, is thereafter reversed" is deleted as
surplusage.

The reference to the defined term "county" is substituted for the former
reference to "the county commissioners of the county ... or the Mayor and
City Council of Baltimore" for brevity. See § 1-101 of this article for the
definition of "county".
