Article - Courts and Judicial Proceedings

11-110.

(a) (1) In this section "pet" means a domesticated animal.
(2) "Pet" does not include livestock.

(b) The measure of damages for tortious injuries to OR DEATH OF a pet is THE

(1) the market value of the pet before the injury OR DEATH [or]; OR

the [treasonable] ACTUAL cost of veterinary care [, but not more than
$3,500 $5,000 if such charge is greater].

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall be
construed only prospectively and may not be applied or interpreted to have any effect
on or application to a cause of action arising before the effective date of this Act.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1999.

Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 301.

Current law contains a specific statute for the handling of charges filed against law
enforcement officers and educators. This bill adds "emergency services personnel" to
the current statute for handling charging documents.

House Bill 537, which was passed by the General Assembly and signed by me on May
13, 1999, accomplishes the same purpose. Therefore, it is not necessary for me to sign
Senate Bill 301.
