SECTION 3. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:
Article—Education
12-111.
(a) Except as otherwise provided by law, appointments of the University
System of Maryland are not subject to or controlled by the provisions of the State
Personnel and Pensions Article that govern the State Personnel Management System.
(b) After appointment, employees in positions designated by the University
shall be regarded and treated in the same manner as skilled service or professional
service employees, with the exception of special appointments, in the State Personnel
Management System and:
(1) Have all rights and privileges of skilled service or professional service
employees, with the exception of special appointments, in the State Personnel
Management System;
(2) Have the right of appeal as provided by law in any case of alleged
injustice;
(3) Shall be paid salaries not less than those paid in similar
classifications in other State agencies; [and]
(4) Shall retain their vacation privileges, retirement status, and benefits
under the State retirement systems; AND
(5) HAVE THE RIGHT TO PARTICIPATE IN COLLECTIVE BARGAINING IN
ACCORDANCE WITH TITLE 3 OF THE STATE PERSONNEL AND PENSIONS ARTICLE.
(e) Subject to subsection (b) of this section, the Board of Regents shall
establish general policies and guidelines governing the appointment, compensation,
advancement, tenure, and termination of all classified personnel.
SECTION 4. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

[SECTION 4. AND BE IT FURTHER ENACTED, That this Act shall remain
effective for a period of 4 years and, at the end of June 30,1999, with no further action
required by the General Assembly, this Act shall be abrogated and of no further force
and effect.]
SECTION 5. 4. AND BE IT FURTHER ENACTED, That the Maryland Higher
Education Commission shall develop operating and capital budget funding guidelines,
in accordance with the requirements of § 11-105 of the Education Article, based on
current and aspirational peer institution comparisons and other appropriate factors.
The Maryland Higher Education Commission shall develop the funding guidelines in
