or who violate certain provisions of a certain local public law; authorizing the
Board to hire a program coordinator; requiring that the position be funded out of
specified revenue; eliminating a requirement that a clerical or administrative
assistant position be subject to the Charles County Personnel Policies and
Procedures Manual; and generally relating to the powers of the Charles County
Board of Fire and Rescue Commissioners.

BY repealing and reenacting, with amendments,
The Public Local Laws of Charles County
Section 54-7 C.

Article 9 - Public Local Laws of Maryland

(1994 Edition and June 1998 Supplement, as amended)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 9 - Charles County

54-7.

C. In addition to any other powers that are granted under this chapter, the
Board of Fire and Rescue Commissioners may:

(1) Swear witnesses and take sworn testimony;

(2) Hire a PROGRAM COORDINATOR, A clerical or administrative
assistant. OR BOTH, provided that:

(a) The THE salary and benefits of the PROGRAM COORDINATOR
AND clerical or administrative assistant are paid out of fire and rescue taxes; and

(b) The position of the clerical or administrative assistant is subject
to the provisions of the Charles County Personnel Policies and Procedures Manual
;
and

(3) After consultation with the County Attorney:

(a) Require, as a condition of receiving tax moneys, each County
Fire Department and Rescue Squad, including a mobile intensive care unit, to submit
financial records or minutes of meetings to the Board;

(b) Remove from office, or bar from office, in any County Fire
Department or Rescue Squad, including a mobile intensive care unit, any individual
who refuses to submit any record as required under this [section] CHAPTER or
otherwise deliberately violates the provisions of this [section] CHAPTER; and

(c) Provide for an appeal process for any individual charged with a
violation under this section.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 1999.
