1997 LAWS OF MARYLAND

THE STATE, TO COVER A CLASS OR CLASSES OF INDIVIDUALS ELIGIBLE FOR
INSURANCE UNDER THE GROUP LIFE POLICY.

(F) SIMILAR GROUPS.

A POLICY OF GROUP HEALTH INSURANCE MAY BE ISSUED TO COVER ANY
OTHER SUBSTANTIALLY SIMILAR GROUP THAT, IN THE DISCRETION OF THE
COMMISSIONER, MAY BE ELIGIBLE FOR GROUP HEALTH INSURANCE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 471(1) through (5).

In subsection (a) of this section, the reference to groups of "individuals" is
substituted for the former reference to groups of "persons" because group
health insurance policies cover "individuals".

In subsections (b)(l)(i)1 and (d)(1)(i) of this section, the former references to
"employees" of an employer, which were included in the lists of individuals
who may be included in the term "employee", are deleted as implicit.

In subsections (b)(l)(i)2 and 5 and (d)(1)(ii) of this section, the references to
a "sole" proprietor are substituted for the former references to an "individual"
proprietor to use common terminology and for consistency throughout the
article. Similarly, in subsections (b)(1)(i)2 and (d)(1)(ii) of this section, the
references to a "sole proprietorship" are substituted for the former references
to an "individual proprietor" to use common terminology for the business
entity.

In subsection (b)(1)(ii) of this section, the words "bona fide", which formerly
modified "employee of the corporation", are deleted as surplusage.

In subsections (b)(2), (c)(2), (d)(2), and (e) of this section, the references to a
policy issued to "cover" specified groups are substituted for the former
references to a policy that "insur[es]" those groups for consistency with
subsections (a) and (f) of this section and other provisions of this subtitle.

In subsection (e) of this section, the former reference to an "organization",
which was specified as an alternative to any "person" to which a policy may be
issued, is deleted as included in the defined term "person".

As to the reference in subsection (e) of this section to persons to which a
policy of group life insurance may be issued or delivered and the classes of
individuals eligible for insurance under a group life policy, see Title 17,
Subtitle 2 of this article.
