(a)     (2) (ii) The Director is in the [unclassified] EXECUTIVE service [of] IN
the State Personnel Management System and shall hold office at the pleasure of the
Adjutant General.

(b)     (1) Subject to the authority of the Adjutant General, the Director may
employ professional, technical, clerical, stenographic, and other personnel within the
appropriations and (except as to the position of Director) subject to the conditions and
limitations of the State Personnel and Pensions Article [that govern the classified
service].

(c)     (2) Except as otherwise provided by law, during the effective period of any
such regulation, the said employees and officers shall be subject to the rights, duties,
privileges, and responsibilities of the provisions of Division I of the State Personnel and
Pensions Article [that govern classified service employees], with the particular board of
county commissioners or county council, or the Mayor of Baltimore City, as the
appointing officer thereunder.

(b) (2) The deputy is in the [unclassified] EXECUTIVE service of the State
Personnel Management System and serves at the pleasure of the Commissioner.

(b)     Except as otherwise provided by law, all positions in State Use Industries are
[in the unclassified service of] SPECIAL APPOINTMENTS IN the State Personnel
Management System.

(c)     All office secretary and office clerk positions in State Use Industries are in the
[classified] SKILLED service [ of], WITH THE EXCEPTION OF SPECIAL APPOINTMENTS,
IN the State Personnel Management System.

(b) (1) (i) [Except for the positions listed in subparagraph (ii) of this
paragraph or as otherwise provided by law, all] ALL officers and employees of the
Department shall be appointed and removed by the Department in accordance with the
provisions of the State Personnel and Pensions Article [that govern the classified
service].

(ii) The following positions are in the [unclassified service of]
EXECUTIVE SERVICE, MANAGEMENT SERVICE, OR ARE SPECIAL APPOINTMENTS OF
THE SKILLED SERVICE OR THE PROFESSIONAL SERVICE IN the State Personnel
Management System:

1. Commissioner;
