ancillary support space. The parcel shall not be less than 22 acres
in size;

(3)    the Department of General Services has certified that the new
hospital site has adequate sewer and road infrastructure to
service the new facility;

(4)    representatives of the Department of Health and Mental Hygiene,
the Mental Hygiene Administration, the Eastern Shore Hospital
Center, and community provider organizations have collaborated
in determining the needs of those currently residing and/or being
treated in the hospital, the opportunities for treatment in
alternative settings, and the level of community support required
to complement the services provided by the Eastern Shore
Hospital Center and included the results of this collaboration in
a report to the committees;
                           

(5)    the Departments of Health and Mental Hygiene and General
Services have reported to the budget committees on the feasibility
of designing the replacement facility to allow initial construction
of up to 78 beds with support spaces sized to allow the future
addition of beds to the maximum of 96; and

(6)    the committees have reviewed and commented on the report or
45 days have elapsed from the date the committees received the
report.

It is the intent of the General Assembly that State funding of the
replacement facility not exceed $20 million
