(2) Any civilian employee of the DEPARTMENT OF [Maryland] State
Police assigned to enforce this subtitle or any regulation adopted under this subtitle, but
only while acting under written authorization of the [Superintendent] SECRETARY of
the [Maryland] State Police.

DRAFTER'S NOTE:

Subsections (b) and (g) of this section are amended to reflect the
establishment of the Department of State Police as a principal department of
State government by Chs. 165 and 166, Acts of 1994, to reflect the status of the
head of the Department as a Secretary of a principal department of State
government, and to delete surplus language.

23-102.

(a)     There is an Automotive Safety Enforcement Division in the DEPARTMENT OF
[Maryland] State Police.

(b)     The Division shall have those employees that the [Superintendent]
SECRETARY of THE State Police assigns and as provided in the State budget.

(c)     (2) Civilian employees of the Division designated by the [Superintendent]
SECRETARY of the [Maryland] State Police shall have the authority to enforce this
subtitle and any regulation adopted under it when acting under written authorization of
the [Superintendent] SECRETARY.

DRAFTER'S NOTE:

Subsections (a), (b), and (c)(2) of this section are amended to reflect the
establishment of the Department of State Police as a principal department of
State government by Chs. 165 and 166, Acts of 1994, to reflect the status of the
head of the Department as a Secretary of a principal department of State
government, to make a stylistic change, and to delete surplus language.

23-301.

(c)     "Hazardous materials inspector" means a person who is assigned by the
Department of the Environment and certified by the DEPARTMENT OF [Maryland]
State Police to perform an inspection authorized under this subtitle.

(d)     "State Police officer" means:

(1)     Any uniformed law enforcement officer of the DEPARTMENT OF
[Maryland] State Police; or

(2)     Any civilian employee of the DEPARTMENT OF [Maryland] State
Police assigned to enforce any rule or regulation adopted under this subtitle, but only
while acting under written authorization of the [Superintendent] SECRETARY of the
[Maryland] State Police.
