SECTION 3 2.5. AND BE IT FURTHER ENACTED, That if any provision of
this Act or the application thereof to any person or circumstance is held invalid for any
reason in a court of competent jurisdiction, the invalidity does not affect other provisions
or any other application of this Act which can be given effect without the invalid provision
or application, and for this purpose the provisions of this Act are declared severable.
SECTION 4. 3.6. AND BE IT FURTHER ENACTED,, That this Act shall take
effect July 1, 1995.

AN ACT concerning
Morgan State University - Creation of Positions
FOR the purpose of authorizing the Board of Regents of Morgan State University to
create positions subject to certain conditions; requiring the Board to submit a
certain annual report to the Department of Budget and Fiscal Planning, the
Department of Fiscal Services, and the Maryland Higher Education Commission;
requiring that certain positions authorized under certain provisions be limited as
specified annually in the State budget bill; providing a certain effective date for certain
authority to create positions under this Act; requiring the Board of Regents to provide a
certain report to the Legislative Policy Committee by a certain date; providing for the
termination of this Act; and generally relating to the Board's authority to create
positions.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Education
14-104.
(f) (1) (i) On the recommendation of the President, the Board of Regents
shall establish general standards and guidelines governing the appointment,
compensation, advancement, tenure, and termination of all faculty, executive staff, and
professional administrative personnel in the Morgan State University.
(ii) Subject to such standards and guidelines, the President may;
