4-902.

(a)     (1) Application for a special police commission shall be made to the
[Superintendent] SECRETARY of the [Maryland] State Police upon such form as the
[Superintendent] SECRETARY prescribes.

(b)     As part of the application for a special police commission, the applicant shall
submit to the DEPARTMENT OF [Maryland] State Police:

(1)     A complete set of the applicant's legible fingerprints taken on standard
fingerprint cards; and

(2)     Payment for the cost of the fingerprint card record checks.
DRAFTER'S NOTE:

Subsections (a)(1) and (b) of this section are amended to reflect the
establishment of the Department of State Police as a principal department of
State government by Chs. 165 and 166, Acts of 1994, to reflect the status of the
head of the Department as a Secretary of a principal department of State
government, and to delete surplus language.

4-903.

(a)     The [Superintendent] SECRETARY of the [Maryland] State Police shall
conduct an investigation into the character, reputation and qualifications of the person
named in the application. The investigation shall be carried out under the rules and
regulations prescribed by the [Superintendent] SECRETARY and shall include an
investigation regarding the applicant's criminal record, including, but not limited to
checking records of local police departments and the Federal Bureau of Investigation.
The results of the investigation shall be transmitted to the Governor with a
recommendation as to the denial or granting of the application and the reasons therefor.
The Governor may accept the recommendation as submitted but is under no obligation to
issue a commission approved by the [Superintendent] SECRETARY if [he] THE
GOVERNOR believes it not in the best interest of the State to do so.

(b)     The [Superintendent] SECRETARY of the [Maryland] State Police may
promulgate such rules and regulations as to the conduct of the special police as [he] THE
SECRETARY deems necessary in order fully to carry out the purpose and provisions of
this subtitle and may require such training and education as [he] THE SECRETARY
deems necessary.

DRAFTER'S NOTE:

This section is amended to reflect the status of the head of the Department of
State Police as the Secretary of a principal department of State government in
light of Chs. 165 and 166, Acts of 1994, to make stylistic changes, and to delete
surplus language.
