PARRIS N. GLENDENING, Governor                                 Ch. 335

2-1310.

(A)     THERE IS A LEAD HAZARD ADVISORY COMMITTEE IN THE DEPARTMENT.

(B)     THE DEPARTMENT SHALL DEVELOP ALL REGULATIONS, POLICIES, AND
GUIDELINES IMPLEMENTING THE PROGRAM IN CONSULTATION WITH THE LEAD
HAZARD ADVISORY COMMITTEE.

(C)     THE LEAD HAZARD ADVISORY COMMITTEE CONSISTS OF SEVEN
MEMBERS, APPOINTED BY THE GOVERNOR AS FOLLOWS:

(1)      THE SECRETARY OF THE DEPARTMENT OR THE SECRETARY'S
DESIGNEE;

(2)      THE SECRETARY OF THE DEPARTMENT OF THE ENVIRONMENT OR
THE SECRETARY'S DESIGNEE;

(3)      THE SECRETARY OF THE DEPARTMENT OF HEALTH AND MENTAL
HYGIENE OR THE SECRETARY'S DESIGNEE;

(4)      A MEMBER OF THE LEAD POISONING REDUCTION PREVENTION
COMMISSION;

(5)      A REPRESENTATIVE OF OWNERS OF RESIDENTIAL RENTAL
PROPERTY BUILT BEFORE 1950;

(6)      A REPRESENTATIVE OF A CHILD, YOUTH, OR HEALTH ADVOCACY
GROUP; AND

(7)      A MEMBER OF THE PUBLIC WHO HAS AN INTEREST IN THE SUBJECT
OF LEAD IN THE ENVIRONMENT.

(D)     THE SECRETARY OF THE DEPARTMENT OR THE SECRETARY'S DESIGNEE
SHALL BE THE CHAIRPERSON OF THE LEAD HAZARD ADVISORY COMMITTEE.

(E)     (1) THE TERM OF A MEMBER OF THE LEAD HAZARD ADVISORY
COMMITTEE IS 4 YEARS.

(2)      THE TERMS OF THE INITIAL MEMBERS OF THE LEAD HAZARD
ADVISORY COMMITTEE EXPIRE AS FOLLOWS:

(I)       TWO IN 1997;

(II)     TWO IN 1998; AND

(III)    THREE IN 1999.

(3)      AT THE END OF A TERM, A MEMBER CONTINUES TO SERVE UNTIL A
SUCCESSOR IS APPOINTED AND QUALIFIES.

(4)      A MEMBER WHO IS APPOINTED AFTER A TERM HAS BEGUN SERVES
FOR THE REMAINDER OF THE TERM AND UNTIL A SUCCESSOR IS APPOINTED AND
QUALIFIES.
