37.01.25                          DIVISION OF HOUSING FINANCE

(A)    Partnership Rental Housing Program. Provide funds to be credited
to the Partnership Rental Housing Fund to be administered in
accordance with Sections 2-1101 through 2-1110 of Article 83B:

(2)     Baltimore City Public Housing Replacement, provided that funds
may not be expended for public housing replacement in Baltimore
City under the Partnership Rental Housing program until the
Department of Housing and Community Development (DHCP)
has reviewed for consistency with program requirements any RFP
proposed to be used by the Housing Authority of Baltimore City
for qualification and selection of developers for partnership
projects. DHCP will be required to notify the budget committees
that the review has been completed and the RFP process is
acceptable to DHCP before any funds will be released..................

(B)    Shelter and Transitional Housing Facilities Grant Program.
Provide grants to acquire, design, construct, renovate, and equip
facilities for homeless individuals and families. These funds shall
be administered in accordance with the Code of Maryland
Regulations (COMAR) 05.05.09 (Statewide)...................................

38.01.00          DEPARTMENT OF ECONOMIC AND EMPLOYMENT

DEVELOPMENT

(A)    Technology Advancement Program. Construct a replacement
facility for the Technology Advancement Program at the University
of Maryland College Park, provided, however, that upon completion,
no incubator space for an emerging technology or business shall be
utilized or contracted for, until and unless, the entity seeking such
space agrees in writing to reimburse the University twice the costs
associated with space use and rental should that entity leave the State
of Maryland within five years of being a tenant in this incubator to
pursue expansion, production or manufacturing relative to the
technology which the incubator space facilitated in development.
Reimbursement shall apply only if 40% or more of the company's
employment is transferred outside Maryland. Full reimbursement will
apply to companies that leave the State of Maryland during the first
two years after graduating from the incubator and shall be applied on
a scale which declines to zero on the fifth anniversary of graduation.
Such agreement is in addition to, not in lieu of, any existing
contractual provision applicable to present users
