376 payment well and truly to be made and done we bind ourselves, our and each of our heirs, executors and administrators jointly and severally firmly, by these presents. Sealed with our seals and dated the 27th day of November in the year eighteen hundred and fifty nine. The condition of the above obligation is such that if the above bound Francis I Henry shall well and faithfully perform the duties imposed upon him as clerk of Dorchester County circuit court by the act of Assembly passed at December session eighteen hundred and forty four, entitled an act imposing duties on promissory notes, bills of exchange specialties and other instruments of writing to aid in paying the debts of the state and shall well and faithfully pay into the treasury of the state all sums of money which he may receive by virtue thereof at the period therein limited for that purposes. Know all men by these presents that I William Hubbard of the State of Maryland and Dorchester County for in consideration of the sum of Ninety dollars current money to me in hand paid to James Wheeler (Jr) of the same county and state aforesaid at and before the sealing and delivery of these presence the receipt whereof I the said William Hubbard do hereby acknowledge have granted bargained & sold unto the said James Wheeler his executors administrators and assigns, one mare, one yoak of Oxen and now in the occupation of William Hubbard to have and to hold all and singular the before mentioned mare and oxen above bargained and or mentioned and intended so to be. He the said James Wheeler his heirs executors or administrators or assigns forever. And I the said William Hubbard for myself my heirs executors and administrators all and singular the said mare and one yoak of oxen unto the said James Wheeler his executors administrators or assigns against me the said William Hubbard my executors and administrators and against all and any other person or persons whatsoever shall and will warrant and forever defend by these presence of all |
