WILLIAM DONALD SCHAEFER, Governor

Ch. 6

In subsection (b)(1) of this section, the reference to "creditable service" is
substituted for the former reference to "the actual time served" for clarity and
to reflect the use of the defined term "creditable service". Similarly, in
subsection (b)(2) of this section, the reference to "creditable service" is
substituted for the former reference to "receiv[ing] full-time credit for the
part-time service".

Defined terms: "Allowance" § 20-101
"Creditable service" § 20-101
"Eligibility service" § 20-101
"Medical board" § 20-101
"Member" § 20-101

SUBTITLE 4. SERVICE RETIREMENT BENEFITS.

22-401. NORMAL SERVICE RETIREMENT.

(A)     AGE AND SERVICE REQUIREMENTS.

A MEMBER MAY RETIRE WITH A NORMAL SERVICE RETIREMENT ALLOWANCE
IF:

(1)      ON OR BEFORE THE DATE OF RETIREMENT, THE MEMBER:

(I)       HAS AT LEAST 30 YEARS OF ELIGIBILITY SERVICE; OR

(II)     IS AT LEAST 60 YEARS OLD; AND

(2)      THE MEMBER COMPLETES AND SUBMITS A WRITTEN APPLICATION
TO THE BOARD OF TRUSTEES STATING THE DATE WHEN THE MEMBER DESIRES TO
RETIRE.

(B)      COMPUTATION OF NORMAL SERVICE RETIREMENT ALLOWANCE.

ON RETIREMENT UNDER THIS SECTION, A MEMBER IS ENTITLED TO RECEIVE A
NORMAL SERVICE RETIREMENT ALLOWANCE THAT EQUALS ONE FIFTY-FIFTH OF
THE MEMBER'S AVERAGE FINAL COMPENSATION MULTIPLIED BY THE NUMBER OF
YEARS OF CREDITABLE SERVICE.

REVISOR'S NOTE: This section formerly was Art. 73B, §§ 2-401 and 3-401.

In subsection (a) of this section, the phrase "with a normal service retirement
allowance" is added to distinguish this type of retirement allowance from
other types of retirement allowance. Correspondingly, in subsection (b) of this
section, the phrase "normal service retirement" is added to modify
"allowance".

In subsection (a)(1)(i) of this section, the defined term "eligibility service" is
substituted for "creditable service" since it is used to determine eligibility for
a benefit. See General Revisor's Note to Division II.

The only other changes are in style.
