S.B. 73
SECTION 2. AND BE IT FURTHER ENACTED, That this Act is an emergency
measure, is necessary for the immediate preservation of the public health and safety, has
been passed by a yea and nay vote supported by three-fifths of all the members elected to
each of the two Houses of the General Assembly, and shall take effect from the date it is
enacted.

Dear Mr. President:
In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 73.
This bill would alter the procedure the chief of a law enforcement agency must follow to
increase a disciplinary penalty from that recommended by a hearing board.
House Bill 1604, which was passed by the General Assembly and signed by me on May 26,
1994, accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
Bill 73.

AN ACT concerning
Law Enforcement Officers' Bill of Rights - Final Order
FOR the purpose of repealing a provision that the recommendations of a hearing board
in certain proceedings relating to a law enforcement officer are not binding upon
the chief of the law enforcement agency; requiring a chief in certain proceedings to
affirm or decrease a penalty recommended by a hearing board; repealing a provision
requiring a chief, in certain proceedings, to review the record of a hearing board's
proceedings prior to increasing a recommended penalty; repealing a provision
requiring a chief, in certain proceedings, to allow a law enforcement officer to be
heard; repealing a provision requiring a law enforcement chief, in certain
circumstances, to state the reasons for an increase in a recommended penalty for a
law enforcement officer; requiring a chief law enforcement officer to take certain
steps before increasing the recommended penalty of a hearing board in certain
proceedings relating to a law enforcement officer; and generally relating to
decisions of chiefs of law enforcement agencies concerning recommendations of
punishment.
