WHEREAS, The illegal drug trade cannot be controlled without arresting and
prosecuting white collar dealers and their professional cadr
e, just as street level retail
d
ealers and users are arrested and prosecuted; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 41 - Governor - Executive and Administrative Departments

18-306.

(A)     (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

(2)      "COMMISSION" MEANS THE COMMISSION ON WHITE COLLAR
DEALERS OF ILLEGAL DRUGS.

(3)      "WHITE COLLAR DEALER" MEANS AN INDIVIDUAL WHO:

(I) HOLDS HIMSELF OUT TO THE PUBLIC AS BEING EMPLOYED IN
AND EARNING A LIVELIHOOD FROM A LEGITIMATE OCCUPATION OR PROFESSION,
COMMONLY CHARACTERIZED AS "WHITE COLLAR", THAT MAY REQUIRE
ADVANCED EDUCATION AND SPECIALIZED SKILLS; AND

(II) 1. ASSISTS OR PARTICIPATES IN THE IMPORTATION OR
WHOLESALE DISTRIBUTION OF ILLEGAL DRUGS;

2. SUPPLIES VEHICLES, WEAPONS, OR OTHER EQUIPMENT
FOR ILLEGAL DRUG DEALERS;

3. CONCEALS ILLEGAL PROCEEDS; OR

4. OTHERWISE PROVIDES EXPERTISE TO KEEP ILLEGAL
DRUG MONEY HIDDEN FROM PUBLIC SCRUTINY.

(3) "WHITE COLLAR DEALER" MEANS AN INDIVIDUAL WHO DIRECTLY OR
INDIRECTLY USES BUSINESS OR PROFESSIONAL ENTITIES, OR GOVERNMENT AGENCIES
TO AID OR FURTHER THE SALE, DISTRIBUTION, OR IMPORTATION OF A CONTROLLED
DANGEROUS SUBSTANCE.

(B)     THERE IS A COMMISSION ON WHITE COLLAR DEALERS OF ILLEGAL
DRUGS.

(C)     (1) THE COMMISSION CONSISTS OF FIFTEEN MEMBERS. NINE MEMBERS,
AS FOLLOWS:

(2) (1) TWELVE SIX MEMBERS SHALL BE APPOINTED BY THE
GOVERNOR AS FOLLOWS:

(I) TWO SHALL BE REPRESENTATIVES OF THE DEPARTMENT OF
PUBLIC SAFETY AND CORRECTIONAL SERVICES, INCLUDING AT LEAST ONE
REPRESENTATIVE OF THE MARYLAND STATE POLICE BUREAU OF DRUG
ENFORCEMENT;
